Caught with 5lbs Cannabis

Hello,
SWIM was pulled over with 5 lbs of cannabis in California. Besides this fact, I haven't heard from him and all I know is that he is going to the LA prison tonight.
UPDATE: Bail was $25,000 and I believe he is out now on his way back into town.
What kind of penalties is he looking at?
Sorry for the vague details, but I will update it when I know more.

If its his first charge he will probably get off on some serious probation...He needs to hire a lawyer though

Better to hire one...The court appointed ones are there to guide you to some degree but its not like when you hire one...The hired ones actually try to help instead of just kind of going through the motions...The good ones anyway.

always remember that court appointed lawyers work for the court system. they don't win any extra points for getting you out of trouble. alot of times, they will try to talk you into taking a deal that will screw you rather than help you.
hire a lawyer.

Normally I'd say get bonded out and then flee to Mexico.
In this particular case, it seems the consequences wouldn't warrant all that.

I call absolute bullshit on the people talking about court-appointed lawyers.
YOU GUYS should remember that these people are in these courthouses all the time and when you hire some spiffy outside lawyer they will often have an attitude towards them. They are also far more likely to be able to strike deals for you considering they're working with the people who decide your fate every day.
Unless ya gettin' Cochrane, you might actually be better off with a court-appointed.
My 2cents, gathered information from lawyers in my family who have done both.

I call absolute bullshit on that, from personal experience.
A friend and I were arrested together, at the exact same time, for marijuana possession. We were parked on the side of the road IN HIS TRUCK, when teh cops pulled up, we were done smoking,b ut the truck reeked of pot. He hid the half ounce he just picked up in his ashtray. Cops pull us out, even though he claims the weed, while in his truck, they gave us both possession charges since i was smoking willingly as well.
Anyways, come to court date, we are both on the same day, I go up before him, talk to the judge with my court appointed lawyer, get 1yr supervised probation, $500 fine, $250 court fee, 80 hours community service, and a drug and alcohol course.
My friend goes up, the one that the report said owned the vehicle AND claimed possession, but he has a lawyer that he hired instead of court appointed. He gets 6 months supervised probation, no fine at all, $250 court fees, 40 hours community service, and no classes...
This was about 10 years ago now, but is exactly how it went down.

Always buy the best lawyer you can afford since your future is at stake. Also haggle with the lawyers over price and try to only buy the services you actually use. Don't pay what it would cost to go to trial since you will probably plea out anyway, which doesn't take much lawyer time.

I'd point out that it's not a bad idea to start with a PD and hire a lawyer if your PD isn't doing jack. Often the PD will do enough work to save you thousands of dollars on the real lawyer. It's also a great reason for an extension.

Court appointed lawyers are good for say......Speeding tickets but not going to do you a damn bit of good in a case like this.

He was charged with 2 felonies I believe and was sentenced to serve 90 days in jail. With good behavior he should be out in about 54, since he already served a few days at the time of his arrest.
3 years probation.

Thanks for the update! You probably mean jail instead of prison though. People don't usually go to prison unless they get a year or longer.

That is terrible, but could have been a bit worse.
Do you know if he had any priors or violent offenses/felonies in the past? Apologies if you already mentioned that, I'm having a bit of trouble viewing this entire thread.

That's not so bad considering he had 5 lbs. Would I be correct in assuming he got a lawyer for that? The Jail time will suck, but with good behavior, he'll be out in less than 2 months. Does he have the option for early release from probation for good behavior or anything? A lot of people I know that get probation have the option of 1/2 time for good behavior; in this case, if he had that, I think that would be like a slap on the wrist. I think the worst part about all this is now he's a convicted felon, but hey, he could be just fine even with that on his record.

Yea he could be out in like a month or less with good behavior or even less if there is over crowding.

They are way overworked to take any personal interest in your case. my last public defendant got me a year of probation...except i should have gotten 6 months. yeah i spent way more in probation fees then i would have spent on a lawyer that would have given two shits about my case.

He was in a parking lot (private property) and they searched his car. Not sure on the exact details.

I was in holding with a guy who was going away for 18 months for traffic related tickets (speeding, driving on suspended license, etc. Not one DUI, though). So 90 days for 5lbs isn't bad at all.
