Well the reason the baggie was drug paraphernalia was because the cop saw it had weed in it. He said anything that is used to transport weed or used to smoke it is considered paraphernalia. Bullshit, I know, but at least I didn't go downtown for possession, albeit, for a half gram. The cop was a campus cop, not a city copy, but my ticket is with the city and I just got a referral to the dean. The statement thing isn't necessarily to incriminate myself, it is to explain what happened in my own words, and I guess to hold me accountable to within our meeting. I'm going to play the schools game, but like Prisoner said, there hasn't been a trial yet so I don't know how they can really do anything until then.

STICK TO YOUR ORIGINAL STORY!!! i cant stress that enough. no matter what they say the other ppl involved said or anything else, just stick to ur original story. i just got out of a drug charge in the MILITARY by just sticking to my original story. even if u do change ur story it makes u look even worse for lying in the first place. trust me, i beat the system with no one on my side and got out of the military when my contract was up with an honorable discharge. what happened with me applies to everyone in these situations.....and yes, sweet talking doesn't do any harm. oh and what ojom said is a load of pussy crap. just say the girl is lying bc shes scared and was coerced into saying that......aught to give u some leverage. it did with me.

theres already an admission of guilt.. the fact that he got the ticket.. or citation or whatever.. he had to sign it.. saying that he had para.. failure to sign it would have probably gotten him arrested.. what he's going for tomorrow is to see what course of action the school is going to take.. unlike a judge, the dean can deliver whatever penalty she sees fit for the circumstance.. pretty much without review.. thats why shes the dean..
in order to go over her head you have to take it to the district/state educational board.. and believe me.. they're not going to be ANY help.. your best just kissing ass and praying for forgiveness.. really you are.. as bad as it sounds...

I did not sign the citation as an admission of guilt, the cop was sure to say it. What I signed was an agreement to arrange a court date.

but the school is not the trial.. all the school knows is that theres an incident report regarding drug para with your name on it.. because you signed it.. the burden of proof is with the state.. but in regards to your dorm.. the dean is in charge and only knows what was written on the citation and what your lady friend told her...

regardless of how it's articulated it's a confession, a confession is a
statement in your own words explaining what happened in order to hold
you accountable for your actions

dont play the schools game, play it by the laws, what are you gonna
lose, the privilege of dorm usage, well, it's apparent that a confession
will cost you that anyway

signing a ticket is like an Own Regognisance bond, it's not an admission
of guilt it just keeps you from having to go to jail and bail yourself out
guilt or innocence isnt determined by a piece of paper a cop writes and
you have to sign, it requires a judge to hear the case and give a ruling
if you waive a jury trial

Sounds like the girls threw herself under the bus and there is no way to save her.

Tell the person you are meeting with that it was her bag and you had no idea what it was or what was in it.  Also state that you are fighting the charge and are talking with a lawyer.  Some schools even have a legal department that will give you legal counsel (though usually not in matters directly against the school or a school police officer).

If the girl is cool, she will change her story to cooperate with you guys since she's already taken the heat, no reason for anyone else to go down.  Based on my experiences though this is unlikely, most people have a "If I suffer everybody should" mentality.

Also, clean up and offer to take a drug test.  Drug tests aren't too hard to pass.  Excess water, B-vitamins and creatine have always worked for me...

Same shit happened to me my 1st year of college. I eventually got kicked out of the dorms, but not for any weed charges thankfully.


Review what evidence they have against you; they probably emailed you a list of charges. Do not incriminate yourself! Even though that girl was a dumb bitch, if you and your friend stick to the same story, you guys will be cool. Try and admit to smoking off campus at a friends place. Try to show them that you use responsibly. And if they didn't find any weed ON you, don't admit to ever having weed on campus. That will equate to a big boot in the ass.

I also go to UNT and I heard about some kids getting 'arrested' there the other day for smoking.

I got kicked out of the dorms sophomore year.  Wasn't the end of the world. Moved in with girlfriend for a while.  Stayed with Friends for a while.  I THINK if I remember correctly I was even refunded the prorata portion of what I had paid. Was a little stressful at the time  - but what the hell. You'll prob end up having more fun in an appt.  And if you are over 18 they aren't going to tell your parents why you were kicked out - just tell them noise complaints or some shit.

I would follow this advice, along with everything Pris said.  All they have is a citation given to 3 people for the same plastic baggie, and a confession from 1 of 3.  Don't confess to anything, and you should be alright.

I remember my freshman year in the dorms.  Over the school year, my room alone had 23 incident reports.  We were only sanctioned for 1 of them, and all we got was a slap on the wrist "probation" punishment.  I think it was from incident report #18 or so...

your fine bro, i lived in a 3 person dorm last year and the whole hallway as well. you got your own shower/vanity/bath etc.. so everyone would just blaze it down in the dorms all the time, the ra's knew we smoked and near the end they pretty much said the smoking in the dorms needs to stop. well regardless of that it was the day before christmas break and we had blazed it down in my buddies dorm.
well it turns out their roomates forgot to hide the ratch cap from the gravity bong witch had a tiny bit of weed it in and the gravity bong, well they left it in plain site over the 4 week break. ends up a ra goes into their dorm i guess for regular inspection and finds everything, says it still smells like weed etc..
my buddies come back from break and they are fucked freaked out their is a note in their door that says , you must come see us asap, and you have to meet with the resident director and dean. well it ends up that they are very very very lucky, if it was anyone else at any other time they would have been kicked out 100%. but the dean pretty much told them that he didn't have time for their problems because he was leaving that day for vacation or whatever, and said that if it was anyone else you would've been kicked out. regardless they had to take some drug & alocohol online tests and were put on some sort of academic warning.
they got fucking lucky, in your case you could be in a tricky sitation man just pray to god and pray.

Yeah it was in front of Kerr but we definitely did not get arrested. It was about a week ago. That same night kids did get arrested because they searched a room and found lots of stuff. The cops who had caught us said that if those other cops had been the ones to find us smoking we would've definitely been arrested for possession and taken to jail. He said cops have different philosophies about this whole war on drugs thing, and luckily they cut us some slack.

Yeah that's why I added quotation marks around arrested. Someone just mentioned it off hand, so I assumed the information wasn't that accurate.

That sucks though man. I just go to a friends apartment to smoke.
My roommate smoked in our dorm once when I wasn't there, and it was pretty obvious when I came back.
I told him how I could smell a mild hint of burnt dank all the way from the end of the hall, so that's not gonna happen again.

So I just got royally fucked. That officer, despite saying he was going to overlook the weed, had written everything verbatim that happened. Note, this was not the dean, it was the assisted vice president for student development. This lady was obviously anti drug, her room was full of posters like "Clear your head, quit smoking pot now". In the code of conduct it said she just needs greater of the evidence in making her decision. I wrote a pretty sketchy statement of intent (they said I couldn't see her without doing it, I tried to not write one) and I pretty much got caught in a lie. I admitted to the police report, but not much is going to be done without an appeal to a higher authority. Luckily, the friend who I am in this mess with is pretty smart, and we're not gonna let this end so easily. This lady doesn't know us, doesn't know our intelligence, doesn't know what we have done, accomplished academically, or what we plan on doing. She is treating us like we are not students, just a bullet point on the student code of conduct. That officer gave us a break, saved us from getting kicked out of school and possible jail time. People do have hearts in this fucked system, and I hope someone higher up will give us a fair hearing. Thanks you guys for all your advice, I'll update every now and then.

This happened to me, only I was caught with LSD, Adderall, and bud. intent to distribute all 3. I got kicked out of school though, not just the dorms. LOL - not quite the same but, saw this thread and felt compelled to post in it.
