Yeah..they wouldn't be released until they served their time since their crimes would have occurred prior to legalization.  As far as what would happen to the dealers; supply would go up and demand would go down.  It would then become an over-saturated "buyer's market", where dealers would have to undercut their competition to even continue.  All that aside, people like to do business w/their friends, so I'm sure many would continue to deal it would just be less profitable.

I agree that a pardon would be possible, but I think everyone trying to get pardoned would take a lot of time and effort.  Perhaps people with big sentences would be pardoned, but..pardon one you gotta pardon everyone right?  Idk, I guess we'll have to wait & see.

I don't think it will be federally legalized anytime soon though, I think we really fucked ourselves by making it a medicine.

It may have made strides towards social acceptance, however we're talking about legalization.  Even if it were approved by the FDA, it would take forever for it to go OTC.  I know that there are ways to obtain it medically (even if you have no definable need), but by saying "legalization", and asking about street dealers, I take it you meant freely available over the counter.

The FDA regulates OTC drugs, just as it regulates prescription drugs.  The FDA decides whether to allow a drug to make the switch from prescription to OTC.  To approve a drug as an Over-the-Counter drug, the FDA must find that:

*Its benefits outweigh its risks: In other words, the improvements to your health from taking the drug are more important than any negative side effects.

*Its potential for misuse and abuse is low: That is, the drug should not be habit forming and shouldn’t cause a cheap “high” that would encourage people to overuse it.

*The consumer can use it for self-diagnosed conditions: The drug isn’t for something that needs testing or a doctor’s diagnosis, like high cholesterol. Instead, the drug treats a symptom that’s obvious to the average consumer, like a headache or allergy.

*The drug can be adequately labeled: The warnings and instructions for use are clear and easy to understand without any training.
The drug does not need a doctor’s supervision: The drug is easy to use. For example, the drug doesn’t need a doctor to monitor and change the dosage.

But since it is already a medication it will have to go through that process to be what you were discussing as legal.

There are some counties/states where the penalties are heftier than others, however having a small amount is practically legal anywhere now (different municipalities of course have their own limits).  I think here in NY <2 o's is a misdemeanor.  Also, many people view places that have it available as tourist destinations, it is too bad the fed overrules the state since it could be an economic recovery vehicle.
