Strange story, need advice

Bare with me this is a bit confusing.....
Over the last few months there have been several illegal goings-on at my work. At the end of July my old boss(manager) got his vehicle stolen out of the parking lot. It ended up being planned by himself and a few of the other employees. There was a few thousand dollars worth of deposits it the car at the time it was stolen. The big bosses had to terminate him. A police investigation began and cell phone records, including text messages, were subpoenaed. In these text messages almost all of the employees working for this manager left incriminating messages concerning drugs and money being taken from registers and deposits, even from the safe. For legal and insurance purposes the big bosses did a mass termination of all employees who worked under the retard with the stolen car, me included. I am one of the two people eligible for rehire and I can begin working again immediately. I have to fill out a new application. Now here is my question..... I got a DUI during the course of my employment there. On the new application I fill out it asks if I have been convicted of a felony or misdemeanor, I now have a misdemeanor. Do I include this information or do I leave that area blank and see what happens? Would the police who were investigating the case divulge this information during the course of their investigation to the big bosses anyways or not? Any advice would be appreciated. Thanks.

Personal opinion only - list it on the application. If it comes up and you did not mention it, you will be called out. Chances are, if it doesn't directly impact your job your employers will not make note. Worst case scenario you could explain it to them in the interview (if necessary)

I would be honest and fill it out properly.  If I were one of the big bosses, I would be going over everything with a magnifying glass.  There is no way that I would trust/hire somebody that I caught lying on their application.  Although a DUI isn't great, it isn't a big deal.  A lot of people get them.

I felt the same way, I did fill out the application honestly. I start again tomorrow and although I do feel stupid for getting the DUI, I didn't know for certain if it was a big enough deal to lie about. I started sweating about it and thought I would just fill out a new one when I got there tomorrow. Thank you for reaffirming my original thoughts on the subject.:tongue2:

It's important to note that if the charge is still being investigated, and you have not in fact been convicted yet.

Then you are not obligated to provide any information regarding your pending court case.
You are innocent until proven guilty.

I used to be a recruiter for a staffing firm so perhaps my experience might be of some use to you.

First of all, the police are not going to divulge any information that isn't pertinant to the case they're working. Any skeletons in your closet are not going to come out just because someone else got busted for something completely separate.

HOWEVER, be aware that your criminal background is public record and it may be your company policy that new hires are subjected to background checks. IF YOU FORGE YOUR EMPLOYMENT APPLICATION AND THEY DISCOVER YOU LIED, YOU WILL--NOT MIGHT--YOU WILL BE TERMINATED.

I understand your position. Weigh the pros and the cons. Is this job THAT important to you? What would you do if you were denied employment? What if you were to try to find another job and they also run background checks? Here at least you've already established yourself to be a good person for not getting involved with the drug/theft scheme.

I think the best thing to do would be to put the DUI on the application and if there's room to explain, down play it a LOT. You can't lie about the charge but you can certainly ease the situation by saying something like,

"I was at a friend's birthday and everyone was drinking and I had the fewest amount to drink so I was elected to drive everyone home. I felt sober and agreed but was speeding and got pulled over. The officer saw my friends were clearly drunk and issued me a sobriety test. I blew just over the legal limit and received a DUI."

That shit sounds a lot better than "YEAH I FUCKIN SMASHED like 10 kids on bikes and gave them the finger and threw an empty jack daniels bottle at a police car."

A DUI doesn't make you a shitty person. It just means you made a bad judgement call and that you've learned your lesson. If it's not a chronic thing (like you've had 3 dui's) then I think it might make you a SAFER employee to have since you're trying really hard now not to fuck up--which is why you weren't involved in their drug scheme.

If they shit can you for behing honest, then fuck them. You don't want to work for a place like that anyway. There's plenty of need for pharmacy techs or whatever you're doing in that environment.
