Wait... This may be a dumb question, but why exactly can't he "talk about" his medical condition at the trial? I've never heard of such a restriction at such a trial... But then again, knowing about the judicial system isn't really something I'm very good at. :P

Not a dumb question at all. I have been scratching my head over this type of thing for years. There have been dozens of high profile cases where the jurors have said afterwards that they never would have voted for a conviction had they been aware of the full evidence. I sure hope this guy gets acquitted.

I read about this somewhere else and I think the judge put a gag order on him so he can't mention his condition or why he was growing marijuana...in the name of justice

This gag order shit is insane. One important part of committing a crime is the intent. In this case, they don't care about intent, they care about the binary "did defendant break x law, yes or no?" and if the answer is 'yes', they 'why?' is irrelevant. To add to that, it's shit like that that comes about as a result of people voting for candidates who are 'hard on (for) crime'.

Hmm... Interesting. Yeah, I guess they don't want him mentioning it was probably the only thing he knew to combat MS, which everyone knows is a terrible, degenerative disease. They know if he said that he would win over the jury. I mean, you'd have to be heartless to not sympathize with the guy.

Don't you know in a U.S court of law when defending your self against foolish outdated drug laws you cant overtly mention any facts that may prove your being foolishly prosecuted by unfair and senseless idiots for crimes that harm no one! The reason these words or facts cant be spoke of is because they may invoke free thinking and cause a speedy removal of the cranium from the anus! Which for some fearing this action may be painful because of many years of suffering from this self induced condition!

I found this to answer your questions: http://cannabisnews.com/news/15/thread15363.shtml
Quote:
"A bank robber is not allowed a defense that he was stealing money for his starving children, even if he was," said Rory Little, a Hastings College of the Law professor.
"The general principle is: Motive is not a defense to a crime."
The reason is simple - to prevent jurors from acquitting because of personal feelings"
TOTAL bullshit IMO. The victim should be able to decide whether the person should be punished for their crime, and motive is part of that. Whatever happened to a compassionate legal system?
