Noise Complaint Ticket written incorrectly?
    #10792272 - 08/03/09 01:39 PM (14 years, 6 months ago)

So to make a long story short, I had a party on the weekend, cops got called for the noise and they gave me a 100 dollar ticket.

However, they wrote the wrong city down on the ticket, so technically the address on it doesn't exist, can I dispute this ticket and win? I tried looking at local bylaws and such, but couldn't find anything about ticket errors.

You're in Canada so I don't know the answer but in my experience here in the US these minor things get rapists off so you probably would get it dropped. In Canada they actually lock the right people up most of the time so these minor things they must pentalize you for.

Best thing you can do is just go up there and ask. Say you are moving and you have a date for this so and so but you need to move to start a job or some bullshit. A lot of times they will just say something and let you go since you are being responsible...Plus you can show them the ticket was written improperly.

Just say no I don't live in that city I live here..Then say oh ok I understand now is there anything I can do.

Usually they will be willing to work with you on noise violations at least all of them I have ever had they have.

lol i wonder if he has to go to that city to dispute it?  at any rate i would say if the cop doesn't know what city he's in then clearly he wasn't in the right mindset to be writting tickets in the first place.

this cop probably wasn't even a cop

just some guy who ate a bunch of acid and ecstasy

and bought a cop costume

then stole a cop car

and went around writing fake tickets

he had the wrong city because in his mind he was thinking "man

where the fuck am i?"

that's what happened.

Maybe that is what happened

In all seriousness though, I live really close to the dividing line between the two cities, I can see how they'd think it was Port Coquitlam instead of Coquitlam, but the point still stands that the offending address doesn't exist, so how can they charge me for anything?

Yes you can fight it, and winning is almost certain. I hear about this kind of thing occasionally.

I'm back living with my parents at the moment, this has been a fixed location for a few months now, and was so for 17 years prior. And I'm not going to school right now.

If it were me, I just wouldn't do anything about it. I live in the US, don't know how different it is up there... either way.

If they ever contacted me about paying the ticket or anything I'd just say I don't live in the city that was written on the ticket, and hope for the best.

I'd say the best, most responsible thing to do would be to call up the city and ask about it, say the ticket was written wrong, that you don't live in the city, so do you have to pay it still?

I have had alright luck with the law in the past just being lazy. I got a ticket for a moving violation or something, I had an out of state license, was moving to different adresses at the time, and when I got pulled over the cops never even asked to see my ID, never asked to see my registration, they wrote me a ticket anyways somehow, I guess they spelled my name wrong...

They sent me a bunch of letters apparently ordering me to go to court or they would come arrest me maybe?

I accidentally forgot about it and slept in, two days later I realized I missed it so they re-scheduled another court date and wanted me to show up there. Another few weeks went by and I realized I had forgotten about another court date... I gave the city a call and they asked for my name, I gave it to them and they dropped all my charges. :undecided: didn't have to pay a thing, didn't have to go to court, I got all the sleep I needed thats for sure.

The address really doesn't matter I don't think

I've gotten speeding tickets with the wrong car model on it,

and still had to pay for it, even after going to court, they got my name and that's all they supposedly needed.

well my point wasn't about you specifially, just that to the court and that piece of paper your addy doesn't really mean all that much other than juridiction i guess and where to start looking if you don't show up

I had a moving violation written with the wrong location on the ticket (right jurisdiction, but wrong actual "locale"... I still had to fork over the dough for it, but YMMV.

I think you can definitely get away with it, but unlike these other people you actually have to fight it, don't just expect them to drop it for you.
