Possession of LSD in Utah

ok so, a friend of mine is charged with possession of LSD and Causing and Maintaining a Hazardous Condition in Utah after being arrested for being out of control tripping in Arches National Park a few weeks ago. She just got something in the mail today telling her that she has to be to court in a few weeks and we live in Colorado.
Does anyone have an idea what the charge will be? She doesn't have a lot of money but i am trying to tell her she might need a lawyer on this one.

Yes I think so.
Can you find out what law she is being charged under?
It should say the exact number of the law on the ticket or in the letter.

36cfr2.34"a""4"
http://edocket.access.gpo.gov/cfr_2001/julqtr/36cfr2.34.htm
This one is the standard disorderly conduct law.
The applicable provision is "Creates or maintains a hazardous or physically offensive condition."
If she admitted to being on LSD it may be difficult to fight this charge. The law is quite vague.

and 21uscs44
I am having trouble finding anything on 21uscs44.
Is it actually 21 USC 844?
http://www.deadiversion.usdoj.gov/21cfr/21usc/844.htm
It says they can lock you up for up to a year and impose a $1000 fine.
It doesn't require jail time and I am not sure what the average sentence is for violations of this section. They probably see this type of case all the time, not exactly the crime of the century. Possession of marijuana or any other drug would fall under the same statute.

You should ask some lawyers what the typical first offense sentence is for this.

sheeit, you'll be alright, I was in the FEDs for a lil while, and the mandatory sentancing doesn't start until u get 25 sheets of acid, or 1 gram of raw acid. for just a few hits, she'll probably just get probation.

Not true. The amount of lsd is totally irrelevant to the mandatory sentencing or the statutory minimums or maximums. What matters is how much the legally defined LSD (substance with LSD in/on it)'s mass is.
For one gram (one milliliter if its in solution) you'll get a five year mandatory minimum. Far less than whatever 25 sheets weighs.

I think they did away with the five year minimum for LSD.

nope,
five years for a sugar cube, and ten years to life for anything more than 2 sugar cubes or in 10 ml of water
You might be thinking of the sentencing guidelines, but these don't have anything to do with mandatory minimums established by statute. You still get 10-life for having 3 sugar cubes even if its not even a whole dose between them.
Anybody who harbors any doubt that congress isn't completely idiotic need look no farther than these laws.
