A new perspective on psilocybin mushroom laws?

Given that its not the mushrooms themselves that are illegal, but the compounds contained within them - is there a possibility that perhaps you could argue that the 'amounts' you are being charged for are incorrect if they are weighing mushrooms?

Say that 1% of the dry weight of mushrooms is psilocybin or psilocin ( I do not know the exact amounts, but I know its very minimal ), that would mean that 99% of the weight of mushrooms is legal material - if you were popped by LEO with the fungus, could you make an argument that the amount you could be held accountable for is not the weight of the dried mushrooms, but the actual weight of the illegal chemical constituents?

Does anyone have any idea if this would stand?

They dont do that with pot i dont see why they would do it with mushrooms.

Call me on it if its wrong, but I thought the plant itself was illegal.

the flip side is, a couple high profile cases like this and all of a sudden a new law is passed where psilocybin mushrooms themselves are illegal, and there goes the OMC the way it is today.

The law in my state and im assuming its the same in others is that it is judged by the weight of any mushrooms containing psilos. Over 30 grams in ohio and you are in some shit. They dont care if they are cubes are azures.

If you get caught with an extract my understanding is that they count the number of doses.

As far as i know with marijuana too, its quantity not quality that determines penalties. I can have up to 100grams of weed in ohio and get away with a civil citation. The loss of weed would be worse then that.

Sad but true. A hit of liquid lsd on a cinder block will get you the equivalent of several hundred thousand hits total in court.

That is all intresting and all but I contacted a lawyer(my family member) and he told me he would look that law up for me. He called back a few hours later told me that if you get cought with it basicly everything with it is also "mushrooms". so bag, shrooms, and all would be taken and weighed.
