Just bailed myself out of jail.
    #10344022 - 05/15/09 02:41 PM (14 years, 10 months ago)

$685.

i was going 71 in a 65 on the interstate.  i only had 3 beers and blew .1 and the legal limit is .08

i am pissed that i got a d.u.i.  i wasn't even drunk.  i worked a 14 hour day in my bar.  had 3 beers and went home.  who wouldn't have a beer or two after a 14 hour work day.

none the less,  the next 6 months will suck.

in the words of Charlie Brown.  "UUUGGGGHHHHH"!!!

Thats interesting.  Can you take a picture of those speed limit signs next time you are out?  I'd love to see them.

The signs around here just say (as an example)

Speed Limit
45
MPH

Not

Speed Limit
45
MPH
(well, actually its 50, there is a 5 mph tolerance)

Of course it doesnt say this, but there ussually is a general rule that I have asked cops about.  They say its a 9 MPH tolerance, but they should either have no tolerance, or all tolerance.  Not a mix.

Maybe in your mind there is.  I always find it amusing when people act like there is some set in stone or unspoken but understood tolerance on the speed limits.  If a cop decides to be a nice guy and let you go or not pull you over or a certain depratment is pressed thin on resources so lets a couple MPH slide that is one thing, but there is no actual tolerance, thats just an urban myth.  I've gotten a ticket for being 36 in a 35 before.

i heard they changed their rules around here.  their is no monthly quota no more but a weekly one so the cops are all out full force at the end of the month.

you know thats not what i mean.  i don't drive everywhere going 50 in a 45 because they shouldn't be able to pull me over.  6 miles an hour over is the minimum ticket you can get here.

plus i never speed.  ever.  must have just caught me on an off chance.  at 6 miles an hour over at that which makes it suck more.

also, i think going 6 miles an hour over the speed limit on the interstate should be way more tolerable then in town which is also why i think it sucks he pulled me over.

OP, I hate it for you brother.

Hold your head, my dude.

As if you were drunk after 3 beers.

Hell, you weren't even crunk yet, but you were getting there.

First offense?

I figured that since you said 6 months.

You should have refused to blow the breathalizer.

You should still plead not guilty.

You were speeding while drunk, why are you complaining? Whether you were drunk or not you knew if you got pulled over you'd be fucked, so why speed? You asked for the ticket and you got it.

i am going to fight it.  i blew at the scene but then refused at the station.  not sure if they can use the one at the scene or not when the one at the station is official.

plus my sobriety test shows how sober i am.  its all on video.  i will never fight it all the way.  but i will get a lesser charge and fine hopefully.

So why not just drive the speed limit? I just put my shit on cruise control so I stay a constant speed the whole ride. Plus you don't have to worry about it. I don't drive drunk though, but when driving high out of my mind it helps.

You're supposed to deny at the scene then blow at the station just to give you that much more time, not the other way around.

Either way you look at it, I got a DUI when I was 19 and I learned my lesson, hopefully you did too. It ain't worth it. A DUI will fuck you life up!

I was so drunk I blacked out and ran in to two parked cars. Luckily my insurance covered it but I lost my job, my family was pissed at me, I owe the court about 3 grand, and I'm having a tough time getting a job now.

Hope those 3 beers after a 14 hour day were worth it. Probably could've waited an hour longer to drink legally.

bullshit, yes every town has a tolerance but ask a cop all you want, they will admit to tolerance but won't tell you what theirs is, fuck they could have a 1mph tolerance if they really wanted to be dicks.

Anyways no sympathy to the OP whatsoever, driving after drinking any amount (drunk or not) is just a stupid fucking choice, anyone knows that nowadays.  But yet everyone seems to think they will always be the exception to the rule....

see sir, you did it wrong.

i have been in way worse situations and let the court system  let me out on small fines for it.  their is a total game to playing the court system.

i could plead this all the way down to a careless driving ticket if i work it right.

I'm not trying to be a dick, but acting like it was the cop's fault it was got him in trouble. Should I be able to drive around high all the time? Sure. Should I be able to smoke in my car all day? Sure. Is that the law though? No. The laws suck, but they are what they are. Blatantly disregarding them is what gets people fucked. But hey that's just my take on it. Yeah, slamming a few beers real quick throws a breathalyzer off.

It'll say you were way drunker.

A blood alcohol test is more accurate.

Good job about refusing to blow @ the precinct.

Actually last time I got a speeding ticket it says it right there in black and white about the 9 mph minimum over the limit to be considered "speeding" I live in VA though, so don't know about other states. In a 55 zone where I know there are cops I keep my cruise at 63.

bummer about the ticket, im sure you'll be able to get it reduced to a lesser punishment. good vibes your way.
maybe you should go with the green instead of the alcohol for after-work enjoyment.

Not a mix.

when they get bored enough they'll pull you over for just about anything. or maybe he just got off the phone with his wife and they had a fight. you just never know. i find that the 9 over threshold is usually accurate. in fact, i think a cop is more inclined to be suspicious of you if you're a young man, puttering around going exactly the speed limit. then they know you're trying your damndest not to get pulled over. if your attitude says to them, i'm not concerned with your presence and i dont give a fuck if you pull me for 5 over cuz i'll just get it reduced in court to nothing, then they usually look elsewhere for a bust.

i had a cop behind me for a little bit yesterday..i was going 5-10 miles over the entire time and didn't have a problem

if i got pulled over for going 71 in a 65 i'd be pissed..
are cops that bored?

around here i don't think there's a chance of getting pulled over for that

refusing a breathalizer in my state means you automatically loose your license.

You never should have blown at the scene. Once you got to the station, I bet your BAC would have dropped bellow .08 if you blew a .1

Your probably correct on this but the reason i refused is because if by chance i did blow over, then i couldn't fight it down to a careless and i would be stuck with a D.U.I.

Yes they do take your license.  it is automatically suspended for 6 months.  but if i did blow and got the d.u.i. anyways, it is up to the judges discretion to suspend your license for a minimum of 6 months to a maximum of 1 year for first time offenders.

i have quite a bad reputation with police.  but that was a long time ago.  i quit being the punk that i was.

i haven't even had a speeding ticket in 3 years now.

i have learned a lot of tricks about the legal system.

for instance.  always plead not guilty and don't take the plea bargain until the one they offer in the court date before trial.

did you know a judge doesn't have to honor a plea bargain?  <-- now thats fucked

Do you live in a state where DUI's can get taken off of your record?  Most states allow them to be expunged.

But yeah, I know someone who got pulled for going 5 over the speed limit.

Also, I've gotten pulled for goign 63 in a 65 on the passing lane on the interstate.  But I really couldn't help it because the transmission in my car SUCKED going uphill.
