were you recieveing spores? i would just throw the letter in the trash, its the usda, they can actually enforce any actual jailtime for shipping spores, the worst they could do is tip off state police if spores are illegal in your state.

It says plants, he was probably shipping without a license, which if they decide to enforce is a no-no. You can ignore it, just stop shipping or get a license. This belongs in S&S.

I would just stop sending things, call if you want to make sure; you don't want them to send more angry letters. Take the proper measures to get a license to ship live plants, this sort of thing is a rare occurrence as many members ship live plants on a daily basis and have no problems; if I remember the license is only like thirty dollars, well worth it.

Haha, that sucks. I had no idea you needed a license to ship plants; the lady in the post office has heard me say I'm shipping plants multiple times.

you should get CITES or phytosanitory certification to ship plants between continents. but it is an extra expense which most people do not want to pay out, i've never got the proper paperwork and never lost a plant despite importing 100's from outside of europe. you can consider yourself unlucky to get caught.
exactly which type of paperwork would depend on what species we are talking about here.

Interstate commerce, at least within the US regarding live plants is loosely regulated; if I remember he is from Hawaii, shipping it to the continental US could cause some problems if they were opened; do as uare says.

I wouldn't call, just let them call you if they need to. If nothing else, you could say you never got a letter...
I know when customs grabs pills ordered from overseas, they send a letter, and the last thing i would do is call them, which is what many others in the business of buying pills online do, just ignore it, and they don't do anything...usda on the other hand, that could be some deep shit there.

WTF was the plant? Thats all that really matters IMO. Play dumb and pay the incineration fee if there is one. If its illegal, than you are looking at smuggling and conspiracy charges.

if this is real, definitely call them. just say you didn't ship anything, and that this letter took you for complete surprise. you're not sure what they're talking about.

And then you've turned what may not have been anything into a crime.
I would personally ignore the letter and do shipping legally in the future.
As far as any consequences from the shipment, it is best to say nothing at all. Not "I didn't do it" not "I'm sorry" just nothing.

Yep. Keep your mouth shut. I wouldn't go mailing out of the country anymore under your name or addy.
On a side note, if the mail in question is illegal and you call, who is to say thats not a federal officer of sorts that you are talking too. If it is, now you've just lied to a fed. Thats a crime.

You should tack the letter on your wall, frame it maybe and don't respond.
Its important at this point to SHUT UP and don't say anything.
You have the right to remain silent, anything you say may be used against you in a court of law. You have the right to consult with an attorney and to have that attorney present during questioning.
Not responding / saying nothing will not look bad at all if it does end up in court.

My guess is him being not part of continental US and having live plants shipped in and getting a dog to hit on it was just bad luck. Hope the plants are ok.

I think its BS that dogs pick up on plants and dirt. The sheer volume of plants, dirt, etc that is shipped around the US makes this an overwhelming tasks for the postal police. Not only that, but a dog hitting on dirt or plants couldn't possibly be enough to get a warrant. Thats not solid at all.
My feeling is that someone ratted you out and the cops used dome BS story.
I can't find anything on the net saying that dogs hit on plants or dirt btw. Also, plants and dirt are everywhere. It like getting a dog to hit on oxygen.

Regardless, it was Salvia, so it's okay, but yeah, I thought it was pretty damn odd that they found the box being sent to me. There really was no just cause written on the warrant at all either.

Who is them? Get the warrant from the clerk.
Original poster- you mention the warrant was crap. Did you see the warrant application?
If not why don't you get it and tell us what the evidence was. Also, what did the warrant say?
Was it a federal warrant?

It said the box what 'suspected' of containing live plants, plant material, blah blah, plant-type stuff. Here it is -> "fresh fruits, fresh vegetables, live plants and parts thereof, seeds and seed pods through the united states mails, possessed in violation of title 7, united states code, sections 7701 et. seq. and evidence of said violations"
It wasn't federal, it was like US District Court of Hawaii or something
