'Saggy Pants Bill' slouches over first legislative hurdle

NASHVILLE -- This is one of those issues where you either think both sides are right or you wonder whether there aren't more pressing matters to debate.

A pair of Memphis legislators argued Wednesday over whether a bill to fine people who wear their pants so low they expose their underwear amounts to "legislating fashion" or "legislating decency and hygiene."

The "Saggy Pants Bill" makes it a misdemeanor to "knowingly wear pants below the waistline, in a public place, in a manner that exposes the person's underwear or bare buttocks." It defines underwear as "clothing worn between the skin and outer layer of clothing, including but not limited to boxer shorts and thongs."

House Bill 2099 allows a citation punishable by fines of $200 to $1,000 and 40 to 160 hours of community service, but no jail time. Proceeds from fines would buy school books, band and sports equipment.

Sponsored by Rep. Joe Towns and Sen. Ophelia Ford, both Memphis Democrats, the bill won approval in a House subcommittee Wednesday after an exchange between Towns and Rep. Karen Camper, D-Memphis, who opposed it as unnecessary.

The discussion opened with a wink and a nod -- "This is the 'crack' bill, and I think any respectable citizen would be against crack," said Towns -- but moved quickly into a face-off over the role of government, individual expression and decency.

"I am absolutely against this bill," said Camper. "I think it's targeting a certain group of people. I think it will put misdemeanors on people's records as we try to legislate fashion. We may not agree with the fashion statement they're making. I don't like it. But you yourself said the parent ought to be involved. Now what you're proposing is to put government in that process.

"My question to you Mr. Towns is: What is the demographics you are targeting with this legislation?"

Towns bristled at the suggestion he's targeting any group. "There's an old saying: If the shoe fits. Black kids are not the only kids wearing their pants at a certain level. It's Hispanic kids, it's white kids, it's a culture in this country.

"This bill says whatever you have on, you should not have your rear end or your underwear exposed to the public. ... It has nothing to do with fashion. It has to do with decency and hygiene."

Camper said similar legislation could have targeted her years ago when "hot pants" were in vogue, or today if the top of her bra is inadvertently showing.

Towns said there's also a hygiene issue. "If you go into some of these restaurants, McDonald's or some of these restaurants where these young people are working and they are serving you while they're pulling their britches up, it's a hygiene concern."

The bill is next set for review April 1 in the House Judiciary Committee. The Senate version hasn't begun moving.

Saggy Pants Bill

I once ran some full (basketball) with a kid of perhaps 15 or 16 that kept adjusting his long, baggy/saggy shorts "just- so" to make sure he looked like an awesome motherfukkin OG. He had the elastic waistband below his asscheeks to expose his OG boxers; I don't know how the damn things stayed up at all. Anyway, I told him he was going to bust his ass and advised that he pull up his damn pants. He didn't say anything but I could sense him thinking "shut up old man".

Sure enough, a bit later he was trying to run out on the break when his pants dropped and tangled him up. He knocked his front teeth out when he faceplanted the asphalt. I have to admit, I felt sorry for his stupid ass even though he kinda deserved it.

This is a load of shit. How can anyone tell someone they can'not wear something like baggy pants or whatever? I'll tell ya why, they have a stick up they ass and the holier than thou attitude makes they ass stick out. Bunch of fuckin morons with nothin better to do than gawk and complain. Fuck em.

Now let me say that those fairy ass baggy jenco's or whatever other brand they are, look like they don't give a shit about appearance. I would like to take my scissors and cut a slit up the middle to make em into a split skirt so they can wear them with even more pride.

But that does'nt mean I can tell someone not to wear fairy ass baggy jeans.

I am absolutely against this law by the way. I think baggy/saggy pants are dumb as shit but unless the morons are violating some real law what is the difference how they cover their nakedness? Your average plumber is more obscene. And the whole thing of trying to define underwear is stupid - what if I wear jeans with no drawers? Am I an offender? Besides some of the baggy/saggy crowd wear briefs under their high riding boxers - are they exempt? This is one of the stupidest pieces of attempted legislation that I have ever seen.

i think this law is retarded. funny, but retarded. if their concern is hygene, and don't want their burger flipped by someone constantly adjusting their pants, then doesn't it make more sense to pass a law stating that mcdonalds has to enforce a dress code?
