South Dakota Bans Salvia Divinorum Possession - But Not Sales

SD Bans Salvia Divinorum March 4, 2009 - ksfy.com
The South Dakota Legislature has given final approval to a measure that would immediately ban Salvia divinorum, a hallucinogenic plant that some have compared with LSD.
The House voted 61-7 to accept changes the Senate had made in the bill. The measure banning possession of the drug would become law immediately if signed by Governor Mike Rounds.
Officials say the drug is gaining popularity.
Representative Lance Russell of Hot Springs tried unsuccessfully to delay approval of the bill. He says the measure should be changed so it would also make it a crime to distribute the new drug.

Haha, yeah that's the tricky part.
South Dakota is only the latest state to jump on the ban salvia bandwagon. Nebraska banned it 2 weeks ago, and similar measures are before legislatures in Alabama, Iowa, Maryland, Michigan, Minnesota, New Jersey, North Carolina, Ohio, Pennsylvania, South Carolina, and Texas.
Thirteen states -- Delaware, Florida, Illinois, Kansas, Mississippi, Missouri, Nebraska, North Dakota, Oklahoma, and Virginia -- have classified salvia as Schedule I under state drug laws. Make that 14 now that South Dakota has joined the list. Three more -- Louisiana, Maine, and Tennessee -- restrict the sale of the plant. Maine and California ban it only for minors.
The Maine and California ban seems to be the only ones that make sense. Regulate salvia like alcohol. The other states think sending people to jail for 2 years is the only answer.

You're right last year some guy tried to make it illegal but it never worked out.
I don't understand why they ban possession but not sales that doesn't make any sense, you need to possess it to sell it right?

I guess that means a person could own and/or operate a business that sells Saliva in South Dakota, like over the internet or mail order, for sales to other states/countries, but the physical location of the Saliva, where it would be sent from, would be in another state where its legal. ?

It was an oversight. They'll change it. Legislators were in such a mad rush to pass an 'emergency' bill to ban salvia immediately, they actually forgot to make sales illegal also.
