Somersworth man charged after allegedly selling fake drugs to Portsmouth police

A Somersworth man is facing a felony charge for allegedly selling what he claimed were narcotics to a police informant.
But authorities say the supposed crack cocaine passed to them tested negative for the drug and appears to resemble bubble gum.
Thomas L. Duda, 23, of 151 Indigo Hill Road, is slated to appear in Portsmouth District Court on Friday for a probable cause hearing on a felony-level unlawful sale of a narcotic drug charge.
Portsmouth police allege Duda sold what he represented as crack to a confidential police informant in the Market Basket parking lot at 1645 Woodbury Ave. on Feb. 13.
A police affidavit indicates Duda agreed to meet with the informant and sell the individual $200 worth of crack, with the money provided for the sale being the property of the Portsmouth Police Department.
Police set up surveillance and viewed the alleged "hand-to-hand" drug deal when Duda met with the informant at 2:09 p.m. on Feb. 13.
Court papers indicate a police investigator met with the informant, who turned over a small cellophane cigarette wrapper containing an "off-white substance."
The informant told investigators 'Tom" stated the crack-cocaine "was still soft but that it would harden once it dries."
Police took the substance back to the police station and conducted an initial field test, the results of which came up "negative" for cocaine.
The affidavit states "the substance in the package seemed to resemble bubble gum" and has now been sent to the New Hampshire State Laboratory for further testing.
Lt. Detective Corey MacDonald said police can charge an individual with selling a drug even if the substance portrayed as such turns out to not be a drug.
MacDonald referenced one case in the past where he charged a man with selling LSD even though what the man was purportedly offering turned out to be small pieces of cardboard with Raid insect killer sprayed on them.

the turtle-kneck fake drug dealer was just tryin to hustle up some money ripping off crackheads.
The only danger i see here is he coulda got himself killed. At best someone coulda smoked the bubblegum and decided they dont like crack... ...Dunno why thats a crime

i bet this gets thrown out, unless they have evidence of him selling real crack to people.

Having real crack is not an element of the crime. It might get thrown out for other reasons but thats unlikely in this type of setup scenario where the informant tapes everything.
