Hallucinogenic mushroom case moves forward

A Casper man should face charges in Natrona County District Court alleging he grew hallucinogenic mushrooms in a Casper rental unit, a judge ruled Tuesday.

The decision, by Circuit Court Judge Michael Patchen, came during a preliminary hearing where authorities offered evidence that Anthony Robeski grew three batches of the mushrooms. He allegedly traded some of the drugs for stereo equipment and gave others to people at this summer's Rainbow Family gathering near Pinedale.

Robeski, 33, is charged with possession of psylocybin mushrooms and marijuana, as well as drug possession with intent to deliver.

He was arrested earlier this month after the owner of a rental unit in downtown Casper called police to report a suspicious odor. Police say they found mushrooms inside.

Robeski is expected in district court within several weeks for his arraignment.

im pretty sure suspicious odors are NOT a probable cause...
but, would an owner of the place you are renting have the right to allow the police to search your rented unit?

all the cops gotta say when you open that door is i smell weed even when they dont and they can come right on in.this has happened to me. and hell if they find something, it wont matter if the didnt really smell anything. how to fuck do you think these guys get into places, specially when you dont read that they had a warrent, but gained entrance.

They can actually use smell as a basis for search as a result of the "plain smell doctrine". It was held up by the courts in connection with the use of drug sniffing dogs around a car, giving probable cause for search of the vehicle. Unfortunately, as some one else pointed out this is an extremely loose requirement for cause that is easily abused since it is purely a "your word against theirs" situation.

A landlord can NOT give permission for the search of the property even though they are the legal owners. The only thing they CAN do is use their key to let the police in for a search if police already have sufficient probable cause/warrant with an immediate need for entry.

*** I didn't realize the case in question, I was referencing US law, my bad. Sucks either way though.

There was a case in Saskatchewan where a bunch of kids got off of charges for smoking pot in their car. Basically, the cops smelled pot and searched the car without their permission, and in the end the judge ended up saying that "Just because you can smell it doesn't mean it's there. It could have already been burnt."
So yeah the smell of weed up here isn't a good reason for a search, and because of that one case, all other cases built on cops smelling weed can't really get anyone in trouble.
Cops wouldn't really do anything here either other than confiscate it for personal use.

The real travesty in our justice system is that even if all charges are dropped and the case is dissmissed, he will have the felony ARREST on his record until he pays a lawyer to petition the court to remove it.  Even then, some agencies and employers can see that on a NCIC backround check. 
This is the equivelent of a newspaper printing a correction on the inside of the back page after running a headline that you got busted giving blow jobs for crack in a vacant church parking lot.
