 Man gets probation for LSD possession [WEST TEXAS]

In a flashback to the 1960s and ’70s, a 318th District Court jury on Tuesday convicted a 23-year-old Odessa man of LSD possession.
A six-man, six-woman jury took an hour to find Darrin Sterling Stark guilty of having pieces of paper with hallucinogenic lysergic acid diethylamide in a pants pocket when Midland County Sheriff’s Deputy David Glenn arrested him about 11 p.m. on Dec. 4 last year.
Glenn said he had initially arrested Stark for public intoxication upon finding him sitting in his vehicle outside a building in the 3800 block of South Highway 349; but the deputy then discovered the suspicious looking papers that upgraded the offense from a Class B misdemeanor to a state jail felony punishable by six months to two years’ imprisonment.
Stark and his attorney, J.K. “Rusty” Wall, chose to have his punishment set by District Judge Dean Rucker, who gave Stark a five-year probated term because he had no prior felony convictions and a small amount of the narcotic.
Watson, a veteran prosecutor, said LSD cases were relatively common during the “flower power” era of the ’60s and ’70s, but they are now so rare that this was the first he had tried.
Commending Deputy Glenn, Watson said Stark needed to be taken off the street that night. “There was no question that he didn’t need to be driving an automobile,” he said, referring to LSD’s propensity for causing extravagant delusions.
Watson said Texas Department of Public Safety Chemist Marissa Silva of Midland gave key testimony to prove the papers in Stark’s pocket had LSD on them that could be ingested by licking.
“It was pretty unusual,” Watson said, adding the source of the hallucinogen was not ascertained.

No one here cares whether or not Darrin intended to use LSD Zoloft Junkie. He was CAUGHT being in possession of chemicals that have been known to cause deaths aplenty and for that he will be kept away from the sparkling gems of opportunity that are the youth of America.

In case I am at all unclear, you're here at the shroomery where the vast majority of posters are quite familiar with, and amiable towards substances and substance usage. Very very few people here feel anything but compassion for Darrin and disappointment for the fact that we live in a society where a man can have violence initiated upon him while society watches on in a seemingly approving manner.
Probation is a pretty sweet deal btw, especially for LSD possession; relative to what others have received anyway.

it would be very unusual to get anything but probation for a felony personal possesion in texas.
5 years is on the high end, I used to live in one of the worst judicial counties in texas (williamson, I could tell stories all day) and a 3 year probation for felonious possesion was common, if you had a lawyer.
