This story was an eye opener to me ( crazy how many evictions they have to serve on their plate). I saw him being interviewed last night. He said it resulted from the embarrassment and heart strings pulled, of evicting people who had rental contracts and were paying their rents, on places the owner wasn't paying the mortgage.
What do you all think of his call to do this?
The Sheriffs department is suppose to serve them. He is defying the law right now.

while I applaud his efforts and his convictions, he's still obligated to serve these people eviction notices, it's up to those renters to litigate the mortgage holder for their money

The renters have no cause to litigate. They paid money and received value. I will say this. Leases need to be honored until the end of their term. I have no problem with going after the landlords' personal property to make the mortgage companies whole.

According to the interview I saw with him, he will still do evictions in the cases where the bank has followed their part of the process and notified renters in the properties. He was upset about evictions where no notice had been given to the renters by the banks, as required by law. Basically saying that he wasn't going to waste tax payer money doing the banks job for them, notifying renters that the property they were living in was repossessed. He was very clear, that if the banks have followed through their obligations, as defined by the law, then he would honor their eviction requests.
It is the banks duty, not his, to serve eviction notices. It is his duty to remove people, should they refuse to leave, after the banks serve notice. I applaud the guy, assuming he was being honest.

this is why they have cause to litigate, eviction prior to the end of their contract imposes an undue hardship in the renter as they were paying in good faith, had the renter skipped out prior to the end of the contract most land lords would have taken it to civil court to obtain the remaining balance from the lease

That was his problem... the banks weren't providing notice, as they are required to do by law... the banks sent him to a residence to interrupt a family that was eating dinner, had him kick in the door with guns drawn, and force the family onto the street. Literally. He got sick of it and said enough is enough. When the banks start following the law, and issue notice as they are required, then I will follow the law, and evict the people that ignore the notice.
Edit: the above is based upon my interpretation of the interview with him.

I think Pris meant, " Time for the renters to score a cheap mortgage for themselves with the banks. They are already in there and probably paying as much in rent as a mortgage would be. "

It does seem like an opportunity. Most probably shouldn't, though.

just make sure you read the contract carefully, some of these mortgages are assumable and most of these banks are simply seeking to get their money back and are more than willing to work something out
My sister passed away a year ago, of course being dead she was unable to make her mortgage payments, the bank has been pestering my mom to make the payments and trying to find some way of sticking her with the mortgage, they arent willing to take my offer of paying the actual loan amount, less interest and the years that have been paid in, I've referred several other people to them and they refuse to deal with them, I guess it'll sit empty for a few more years
