Cannabis facility drawing attention

For more than a month, a medicinal marijuana dispensary has been quietly operating in a small strip mall on Pacheco Boulevard. It is the first of its kind to operate on unincorporated county land.

Since opening its doors on Jan. 17, Tender Holistic Care, or THC, has been selling medicinal marijuana to card-carrying members with few obstacles.

Unlike neighboring Alameda and San Francisco counties and myriad East Bay cities, including Concord and Pleasant Hill, Contra Costa County has no laws or moratoriums addressing cannabis clubs on county-owned land. That is now likely to change.

Supervisor Mark DeSaulnier, whose district includes Pacheco, says his office has begun talks to draft a law applying to cannabis clubs in unincorporated areas.

"We've been talking about what we can do about it," DeSaulnier said. "In the meantime we want to make sure the existing facility" complies with current laws.

Pacheco Town Councilman Doug Stewart would like to see the county make such a law a priority, whether an outright ban on such clubs or established business guidelines, such as location, hours of operation and special county approval.

"I do want the county to treat (the club) as any other business, but at same time I want them strict," said Stewart, who is also on the Pacheco Municipal Advisory Council to the Board of Supervisors.

Stewart worries that without county legislation other dispensaries are likely to follow unchecked to other unincorporated county areas. In October, a dispensary in Byron was preparing to open its doors when it was gutted by a blaze that fire investigators ruled an accident.

Regarding the Pacheco club, Stewart says he is concerned about possible negative impacts to the area.

"The location is very bad," he said. "It's a major thoroughfare for stolen cars and robberies. And it's less than 100 feet away to the freeway on-ramp."

THC owner John Sullivan has another location in San Diego, which was robbed at gun point last summer. Sullivan, who spoke at a Pacheco council meeting last month, has said he will work with local officials and the Sheriff's Department to ensure that the club does not generate or contribute to crime in the neighborhood.

In the meantime, regardless of the lack of county ordinances, THC's future is uncertain. The business is in violation of building codes as a result of some remodeling Sullivan did to open the store.

Sullivan is also fighting an eviction notice filed by the building owner, Mohd Karim Sayani, who claims Sullivan breached his three-year lease.
