Should Lawfirms Be Able To Advertise Their Services?

From 1908 to 1977, lawyers were forbidden to advertise their services. This prohibition came about through fear of "puffery" and the belief that even the best executed advertising could be unintentionally false, misleading or deceptive because of the complex nature of legal services.
A 1977 ruling of the United States Supreme Court (Bates v. State Bar of Arizona) changed the rules to some degree. Lawyers are now permitted to advertise certain information in newspapers, in the Yellow Pages and on radio and television, but direct solicitation through unwanted visits or telephone calls are improper and unethical. Solicitations by mail are acceptable if they are labeled as advertisements.

Do ads on bus-stop mezzinines, backs of Phonebooks and late night TV partially help perpetuate the present day litigation boom?

We either give lawyers as we do all other professions the opportunity to advertise, or we eliminate all of them...

Now, wouldn't that be a bitch? No more catch phrases... some corporations wouldn't be 'loving it'.

It should be up to the discretion of those who display their ads. You have to remember that a lot of lower-income people are on a tight budget and can't afford some top-notch law firm, so they have to look for the best bargain they can get. I think that what perpetuates frivolous lawsuits is this sense of entitlement people have had since Johnson's "Great Society" in the 60's.

They are part of the private sector, so of course they should be able to advertise for their services.

most of the firms out there that advertise on phonebook covers and late-night TV cater to the plaintiffs side of litigation, usually personal injury. and almost every plaintiff in a litigation action works on contigencey basis (1/3 of settlement or judgement.)

also, if your firm is advertising (at least in my state) your a big-time firm that wouldnt come cheaply anyways.

I think there are much bigger problems with our legal system and lawyers in general than advertising will ever create.

Personal Injury Law Firm and New York Injury Lawyers. Coincidence? I think not. There is clearly a plot of some kind afoot and I mean to get to the bottom of it.
