I was wondering about a hypothetical situation, where say, a man makes a potent kava kava brew and goes driving, extremely fucked up on it. He gets pulled over, and they test him, but he is not drunk, and has not consumed any illegal drugs, and admits to using kava kava. Could they prosecute him for this? What would he be charged with?
Kava kava could be replaced with any legal drug that is not mentioned by law, like smoking a salvia blunt while driving would apply also

If you are intoxicated while driving - or unfit to drive in any matter then you can be arrested for DUI.
Now just for POSSESING it its not illegal. BUT If you use something not in its intended manner. OR If it has "not for human consumption" written on it (ie salvia - I learned this the hard way), then they can prosecute you.

What if he did not admit to using the kava kava then, and would also turn out negative for all drug and alcohol tests? How could they pin a DWI on someone if they didn't even know what they consumed, could the driver not just say he was tired or had a bad flu or such?
I've never heard of this happening to anybody, but I'm sure somebody's done it. A good lawyer could probably get a case like this thrown out in court one might think

they call it impaired driving here. being too tried can give you a ticket and suspension if severe. anything that imapirs ones driving can be used. i suppose its even possible to use weather on such circumstances, but thats a little far fetched even fro the biggest ass of a cop.

Here it would be called "impaired driving" and yes he WOULD be prosecuted for it. In fact, I've heard of people being prosecuted for driving while extremely tired, which is also considered "impaired".

Stupid people like the one in the link you posted, who go out driving on legal drugs when they're too intoxicated, are the ones who bring attention to the drugs and get them scheduled.

Are you sure they can prosecute you for using it? I mean, they can prosecute you for selling something that's not for human consumption (ie. not FDA approved), as something to be consumed, but I don't think they can prosecute you for consuming it.

They can arrest you for driving while sleepy. Any impairment is illegal while driving.
