Ohio's marijuana laws

100g or less is classified under 'civil citation' and you get a 100 dollar fine. since this is not a misdameanor, will it remain on any type of 'record'?

I'm sure it is on a record because generally that fine occurs if it is your first offense, so there obviously needs to be some type of record of it.

Its just like a ticket is. No you dont have to put it on your apps for work and stuff.
Ohio is one of the best states for herb. 100 grams is 12 grams undre a qp, and you get a ticket and walk away
Only bad thing is that they steal your liscense. I have had a friend get his car searched and weed turns up and they just lectured him and made him throw the stuff out. It was about a 1/4 of nugs.
Only bad thing is that they steal your drivers liscense for a few months on any drug offense.

In west virgina is a felony over 15 grams..

Possession of 5,000 grams of marijuana or more is punishable by 1 - 5 years in prison. For any amount or 20,000 grams or more the penalty increases to a mandatory minimum sentence of eight years in prison. Sale or delivery of 20 grams or less, for no remuneration, is considered possession and is punished with a fine of $100. Sale or distribution of less than 200 grams carries a penalty of 6 - 18 months in jail. Sale or distribution of 200 grams or more is punishable by 1 - 5 years in prison. Sale or distribution of 600 grams or greater carries a mandatory minimum sentence of six months and a possible 2 - 8 year sentence. Sale to minors, sale within 1,000 feet of a school, sale within 100 feet of a juvenile, and previous felony drug convictions all increase the penalty for the sale or distribution of marijuana. Possession of paraphernalia is punishable by up to 30 days in jail and sale of paraphernalia is punishable by up to 90 days in jail. For all drug convictions, the offender's driver's license is also suspended for a period of 6 months - 5 years. This does not apply to minor misdemeanor violations for marijuana possess. Professional licenses are also suspended. Conditional release: The state allows conditional release or alternative or diversion sentencing for people facing their first prosecutions. Usually, conditional release lets a person opt for probation rather than trial. After successfully completing probation, the individual's criminal record does not reflect the charge. Mandatory minimum sentence: When someone is convicted of an offense punishable by a mandatory minimum sentence, the judge must sentence the defendant to the mandatory minimum sentence or to a higher sentence. The judge has no power to sentence the defendant to less time than the mandatory minimum. A prisoner serving an MMS for a federal offense and for most state offenses will not be eligible for parole. Even peaceful marijuana smokers sentenced to "life MMS" must serve a life sentence with no chance of parole. Decriminalization: The state has decriminalized marijuana to some degree. Typically, decriminalization means no prison time or criminal record for first-time possession of a small amount for personal consumption. The conduct is treated like a minor traffic violation.

OK...possession of up to 100 g's is a civil citation-- fine only. but sale of MJ between 20 and 200 g's caries a 6 to 18 month prison sentence. if you have 100 g's of herb, couldnt the cops charge you with "possession with intent to deliver" the large size of herb you have on your person (even if the herb isnt separated into individual baggies) could definetely be seen as an aggravating factor that leads the cops to believe you were gonna deal some off--especially if you had a postal stamp scale on you too (Possession of paraphernalia is punishable by up to 30 days in jail and sale of paraphernalia is punishable by up to 90 days in jail. ) it seems to good to be true, but maybe im just kicking myself for moving outta OH in 1995.

Ive know a guy where i grew up that go busted with about a pound with intent to sell and just got probation. It was his first time ever getting in trouble with the law. If you got priors and stuff, they can send you to jail tho.

Ohio is a pretty boring place to live, but because of decriminalized marijuana its a relatively safe haven for pot heads

Well people forget that paraphanalia (which is defined as absolutly anything whatsoever involving drugs) is still a 0-6 months penalty. Perhaps they've changed that, but when they decriminalized they never changed the penalty. So having a crack pipe is the same as having a ciggerette rolling paper.

yeah, i had to have my car searched a couple months ago and they found about an 8th and 2 pieces, but all I got was a lecture and a ride home in the police car. ohio can be cool sometimes..

that's cool, there was a case in a municipal court awhile ago where the paraphanalia ordinance (identical to the state law) of a city was ruled to conflict w/ the decriminilization statute as applied to marijuana paraphanalia
Don't know if this was appealed or whatever, or if anyone else took this view of the law or not.

Looks like they changed the law recently, and lowered the penalty for paraphanalia... still no difference between a syringe and a rolling paper where they are determined to be used for drug administration

to my knowledge, your situation doesn't constitue that offense.
What section of the law were you charged with?
It is possible what they wrote down "felony drug abuse" did not corespond w/ an actual offense of that name.
why don't you look up your records and find the law you were cited with

I'm wrong huh? I only paid 1000 dollars for a lawyer. I got arrested. I know the law, well. I GOT ARRESTED. I went to court.
I'm far from confused.
I got busted with a fat 8th of nugs.
I got charged with a felony five drug abuse charge.
Have you ever been busted with pot in ohio? Just because you got busted for " marijuana possession " does not mean they have to charge you as such.
Confused.....shit...I'm still fuming over it all and it's been 2 years.
