Julia Diaco, 18, of Rumson, N.J., entered the plea in Manhattan's state Supreme Court at her arraignment on charges of criminal sale of a controlled substance in the third degree and criminal sale of a controlled substance in or near a school, and related counts. The two top charges are punishable by up to 25 years in prison. The diminutive Daico, wearing a red quilted jacket, blue exercise pants and handcuffs, stood and listened quietly as Justice Brenda Soloff set her bail at $10,000 and scheduled her next court appearance for May 20. Diaco's lawyer, Marvin E. Schechter, said he was posting cash bail "forthwith" and expected his client to be freed within half an hour. He said Diaco, whose father is president and owner of a New Jersey construction company, had no reason to flee. Assistant District Attorney Jordan Arnold had asked for $25,000 bail. He argued that Diaco is an out-of-state resident who has a drug case pending in her home state. Rumson, the home of rock star Bruce Springsteen, is about 50 miles south of Manhattan. The district attorney's office said Tuesday after Diaco's arrest that she had sold drugs to an undercover officer eight separate times -- in Washington Square Park, on West 4th Street at Sixth Avenue, and inside NYU's Hayden Hall dormitory -- between last Nov. 1 and April 21. Arnold told Soloff that when Diaco was arrested near St. Mark's Place on Tuesday, she was carrying several ounces of marijuana and a scale and was on her way to a prearranged sale of drugs to an undercover officer. The prosecutor also told Soloff that officers with a search warrant found the clothes Diaco was wearing during a sale captured on videotape, and they removed a stash of cocaine and marijuana from a safe in her room in NYU's Hayden Hall. Schecter told the court that "when the facts come out, we will find that a lot of the drugs were for use by herself. The amounts of drugs were small in number." As for the alleged prearranged transaction with the undercover officer, "I think that was an aberrant sale," Schecter said outside court. Schecter said he did not believe that all of the drugs found by police were "necessarily attributable to her." He said he was referring to reports that police found psychotropic mushrooms and other hallucinogens in Diaco's room. The lawyer also explained that the pending drug case in New Jersey involved marijuana possession. He said Diaco was riding in a car with her ex-boyfriend when police stopped them and found marijuana on the floor. He said police gave both of them desk appearance ticket.
