Florida passes random drug tests of state workers.

TALLAHASSEE, Fla. -- Florida state agencies can randomly drug-test their employees under a bill passed Friday by the Legislature - the first of its kind in the nation.

The Senate passed the previously approved House bill (HB 1205) by a mostly Republican party-line vote of 26-14.

It next goes to Republican Gov. Rick Scott, who is certain to sign it. He already tried to enforce random state employee drug testing through an executive order now suspended while it's being challenged in federal court.

When approved, Florida would be the first state to allow for random, "suspicionless" drug testing of all state workers, according to the National Association of State Personnel Executives.

State employees could be randomly tested every three months under the plan. The random sample, however, can't be more than 10 percent of the agency's workforce and must be "computer-generated by an independent third party."

The measure also makes it easier to fire a worker after a first confirmed positive test. No extra money was set aside, so department heads have to pay for tests out of existing budgets. Urine tests, the most common, cost from $10-$40 each.

Rich Templin, legislative director for the Florida AFL-CIO, said the program probably will mean more lawsuits for the state when Scott signs it. AFL-CIO unions represent about 100,000 state employees.

"This is just another attempt to vilify state workers and make them the problem," Templin said.

Some Florida legal scholars have already said the plan likely is unconstitutional. Drug testing invokes the Fourth Amendment, which protects against unreasonable searches and seizures. In this case, private employers can make drug testing a job requirement, but the state cannot.

"State workers don't trade their constitutional rights for a state paycheck or other benefits," said Howard Simon, executive director of the ACLU of Florida. "Unfortunately, the governor and Legislature appear to want to re-learn that lesson over and over again."

Backers of the measure have not produced evidence that drug use among state workers is any higher than the general population.

"I haven't been running across drug-addled employees unable to do their job," said Sen. Joe Negron, a Stuart Republican who voted against the bill.

And aside from law enforcement and other "safety-sensitive" positions, courts have generally frowned on government drug testing of its employees without a reasonable suspicion of individual drug use.

Sen. Mike Bennett, a Bradenton Republican and the chamber's president pro tem, said many state jobs have a safety component, such as forestry workers who cut down large trees. He was disappointed that lawmakers were not included in the measure.

"If we're going to tell the kids in high school they shouldn't use drugs, we should be leading by example," he said. "It's only fair."

Existing law already allows the presiding officers of the House and Senate to set up a drug testing program by rule. Neither chamber has done so.

Sen. Jack Latvala, a St. Petersburg Republican, said he didn't understand opposition to the bill.

"All it does is allow department heads to do (drug testing) on a limited basis, if they have the funds to do it," he said. With Gov. Scott's interest in the issue, it is likely many agencies will find a way.

Sen. Maria Sachs, a Boca Raton Democrat, said suspicionless drug testing is "how we lose our liberties."

"What could be more intrusive than a search of your own body?" she asked. "This is one more step down the slippery slope of becoming a nanny state."

Added Sen. Chris Smith, a Democrat from Fort Lauderdale, "You're talking about testing some clerk at the DMV; what probable cause do you have? This is expanding government for no good reason."

But Sen. Alan Hays, the plan's sponsor in the Senate, said random testing will help state employees with drug problems to get help, though technically the bill makes it easier to fire them.

"Think about the preventative aspects," the Umatilla Republican said. "We owe it to our state employees."

As was I but more so that it passed period. It would be fun to test politicians and lawmakers just to expose them for the shit they do though.

The real interesting part about this law is whether a search for employment purposes will be considered a search under the 4th amendment.  When this finally makes it to the supreme court, we'll have an answer.

Lawmakers are above/immune to the law?

It's like saying "We can't have people doing dangerous things and then going home and using drugs that have been banned, so we are going to pass a law to test them for drugs, but don't test  us, it doesn't matter if we use those same drugs or not, it's THEM we need to focus on, just leave us alone and let us enjoy our drugs, all we do is make the laws so it doesn't matter if our view on what should and shouldn't be the law that controls everyone may be distorted by our altered minds.":rolleyes:

There is a little bit of a difference, however.  The legislators are elected officials, so the argument can be made that the public can elect whomever they want.  If they want a stoner in office, that should be okay.  Drug testing a hired employee, on the other hand, allows the government to weed out (pun intended) some employees who might not be the most efficient use of taxpayer money.
