Senate Passes Medical Marijuana Regulation Bill

State senators passed a bill Wednesday afternoon that would allow local voters or governments to ban dispensaries and impose regulations.

The bill's sponsor, Sen. Chris Romer, a Democrat from Denver, said state regulation is needed because too many dispensaries are selling medical marijuana to anyone who walks in the door.

"Is there a knucklehead factor out there. I'm pretty sure there is. So, we're gonna get the knuckleheads out very quickly, and then the legitimate business people would come in," said Romer.

The bill already passed by the house would allow local voters or their governments to ban dispensaries. Some senators wanted that provision removed along with one allowing cities and counties, instead of the state, to also regulate their own dispensary hours.

Another issue drawing opposition is a requirement that dispensaries grow 70 percent of the marijuana they sell. The provision is aimed at keeping tabs on the drug's supply.

Dispensary owners are willing to put up with criminal background checks and audits to give them protection against possible federal drug raids. Some are worried about having to pay thousands of dollars in fees while regulators finalize the details of rules that could end up putting them out of business.

Sen. Morgan Carroll, D-Aurora, said allowing cities to ban dispensaries violates the constitutional amendment voters passed a decade ago allowing medical marijuana. She said that would open the door to a total ban across the state.

Gov. Bill Ritter has said he won't sign regulations that don't allow for local bans and don't require dispensaries to grow most of their marijuana.

Police, prosecutors and state Attorney General John Suthers have been urging lawmakers not to regulate dispensaries because they say that will legitimize an industry they don't believe was allowed under Amendment 20.

There are more than 24,500 patients on Colorado's medical marijuana registry. Another 83,000 have applications pending.

The senate's version of the bill must be approved after a third reading before it heads back to the House for reconciliation.
