Colombia Supreme Court decriminalizes drugs for personal use

THURSDAY, 25 AUGUST 2011 11:08 TRAVIS MANNON

Colombia's Supreme Court ruled Wednesday that carrying small doses of drugs is not a punishable offense, torpedoing years of effort by the administration of former President Alvaro Uribe to criminalize the personal possession and consumption of drugs.

According to the court, penalizing the personal use of drugs violates the "free development of personality."

The court found that Legislative Act No.2, 2009, which banned the personal use of drugs, "implies the nullification of fundamental rights, and it represses and sanctions with the severest punishments (imprisonment) the personal decision to abandon one's personal health, a choice that corresponds to their own decision and does not infringe on the rights of other members of society."

According to newspaper El Tiempo, the Supreme Court set the "personal amount" of drugs at 20 grams of marijuana and one gram of cocaine.

Colombia's highest court based its ruling on the case of a minor who had nearly 80 grams of marijuana in his possession. While the court decided the amount exceeded personal use, they took the opportunity to overturn the general ban on personal consumption.

The landmark ruling overturns legislation passed by Colombia's Congress in 2009 that penalized the carrying of all amounts of illegal drugs. The passing of the bill was considered a success for Uribe, who for years had been trying to ban drugs, claiming the decriminalized dosage was undermining efforts to combat micro-trafficking of drugs in the cities.

Holy crap, so many great words! I'm very happy for Columbia.
South America has been exercising some excellent logic lately about drugs. A couple countries in SA (Peru was the first I believe) to kick the DEA out and start decriminalizing drugs. 

Why is it that these not so developed nations are being so much more logical about drug use, while all the 1st world (supposedly free) nations are being so oppressive?

For the record, thanks for posting the proposed substance ban links in your sig. It's sad how being (mis/un)informed can lead to revocation of freedom due to "ignorance of the law". The larger our legal code expands, the more likely the average citizen is to break a law and become a "criminal". Sad.

Ok, my mistake.  The images I get from the U.S. are drug cartels, kidnappings, pollluted cities, corruption, and lack of respect for human life.  But looking at the pictures of Bogata I guess your right, I'll take the experience of someone from that country.:sun:

while in Chile I heard a lot of bad shit about columbia from gringos and latinos. Ive also heard a lot of good things about it. Its probably badass but you should probably be careful.

speaking of "gringos"... Im very "gringo" looking, and I travel a lot in the country!, most of what you hear is bullshit, fear and horror stories amongst all other myths are busted as long as you have a feeling and a clear barrier of do's and dont's.
be wise and you can travel the world and the seven seas brother!
Everywhere risks abound, and as so there is not really "dark" places or generalizations that matter anyway, just be careful and avoid and learn to recognize threats withouit being too paranoid or too laid back and youre good to go everywhere!!!

Maybe if I ever get breaded I go see for myself, it does look like a cool place to see.

I wonder when developed countries will legalize the manufacture and sale of recreational drugs, decriminalization is great but it only fixes half the problem as the suppliers are still the same criminals and the quality of the dope is still unregulated. Legalization would be the most logical stance for a country to take. But then again I see alcohol as just as dangerous a drug as any others, and yet society isn't in total anarchy.
