so what you gotta do is find the best lawyer you can....
dont just pick some pin head outta the yellow pages!!!!
Try googling grow operation trials in your area, and see who the defense lawyer was. or ask around for the best drug defense lawyers. maybe look on norml.com

i would think a good lawyer could get you off cuz while you may have had some active stuff you were truelly growing shitakis and those previous were not and obviously abandoned. plus they had no reason to call the drug cops in the first place.

Lets clarify:
- They entered without consent
- They continued to interrogate after an attorney was requested.
- They detained me, restricted my ability to leave, speak or make calls. No arrest. No rights read. Nothing.
- They searched without probably cause or permission (my opinion  ), having responded to a domestic, but deciding to rifle through my bedroom closet? Maybe they thought I was hiding in the tupperware TiT?

Sounds like you had less of a grow op then PF, who also happened to sell spore syringes and the PF Tek. All he got was 6 months house arrest, probation, and a considerable fine. No prison time.

the fact that they searched your home after seeing only shiitake mushrooms (a legal product to grow) should be enough to get that thrown out; however, the laws that govern the US aren't always just. also, i believe (NOT SURE) for domestic distubrance calls, cops may be able to enter your home without a warrant
the facts are: unless you get lucky and all the confiscated items miraculously turn up negative for psilocybin/psilocin, this is going to cost you a lot of money and some time. with a good lawyer, they may be able to get it thrown out, but be prepared for the worst while keeping hope for the best

The good news is they most likely acted upon an unreasonable search. Police are not supposed to err on the side of an extensive, non warranted, non permissive search. You did fuck up tho. You talked to the police.
If any of you ever find yourself in the living room talking to a cop dont say ANYTHING. you may say hello, goodbye, and i refuse consent to ANY searches. If you are EVER asked a question in these circumstances the appropriate response is either A)i refuse consent to any searches and i would like you to leave. or B) i will answer that question when my lawyers present, now i would like you to leave. I do not consent to any searches!

You've got a good case it sounds like, any decent lawyer ought to be able to get you off the hook based on that. Sounds like you did the right things in dealing with the cops, and it may keep any potential charges from sticking.

unfortunately everyone who is saying that you are "off the hook" because they "searched without consent" are simply being naive.
in the simplest terms, "probable cause" and a few other "blanket terms" pretty much leaves it to the discretion of any cop, wise or otherwise (no pun intended), to; search, detain, question, ticket, taze, club, shoot or treat any "free citizen" how/whenever they "deem necessary".
excuse all the quotes... it's for an obvious reason.
but thankfully with capitalism at it's strongest these days, the more you can offer a good attorney, the more likely it is that you can walk away with nothing more than a sore ass. lol.

if you have a good lawyer you could probably get off with just some lost $$
worst case scenario IMO, you will get 6months to a year probation, fines.
