‘Knock-and-talk’ leads to Langley drug arrest

A “knock-and-talk” executed by the Floyd County Sheriff’s Department on Wednesday led to the arrest of a Langley man on drug charges.
Kennis F. Lucas, 58, was arrested by Lt. Gary Tackett, Deputy Delmas Johnson, Sgt. Terry Chaffins and Deputy Kevin Shepherd after they searched his home.
“He told us to come on in, and that his house had been searched before and nothing was found,” Tackett said. “I noticed that he didn’t want to get up from his love seat, so I told him to get up. That’s where we found the marijuana and most of the pills.”
Lucas was charged with possession of marijuana, possession of radios that send and receive police messages, three counts of controlled substances not in original containers, one count of first-degree trafficking in a controlled substance, and two counts of first-degree possession of a controlled substance.
* A loaded .22 rifle was also confiscated at the scene, along with $1,200 in cash.
“A knock-and-talk is when we show up and ask them if we can search their home,” said Sheriff John K Blackburn. “We tell them that there have been complaints from people in the community.”
According to Blackburn, the street value of the drugs confiscated at Lucas’ home, which included oxycodone, hydrocodone and Lorcet tablets, total $5,740.
Lucas is being held in the Floyd County Detention Center on a $50,000 cash bond.

if they knocked to talk on me id tell them they could come back when they had a warrant, what fucking moron lets cops in their house when they have drugs and a loaded gun.

Since when is that a crime?
Most 2m / 440 ham radios can easily be modified to do that.

True but in real life its more complicated then that. The cops came to my door while I was sleeping a couple months ago. I got up and answered the door and they said that my roommates car that was parked out front had expired registration and that I should move it to the driveway so they don't have to impound it.
I guess the proper thing to do is to never answer the door when its police. Or ask what they want through the door.

IF THEY WANT YOU... THEY WILL GET YOU.
In my state suspisious behavior is excepted as probable cause. If you seem nervous, or cold, or sweaty, or your eyes are too red, or too closed, or too open, or YOUR lips too dry, or too wet, or you trip on a word or two, they can radio in for a warrant. It's not uncommon for them to start searching before the warant is delivered.
If they "thought" they saw or smelled something funny going on at the time, they don't need a warrant. If you run from them, or start talking to them but walk away before "they are done with you" they can follow you into your house without a warrant.
While pulling up to a stop sign I sneezed 3 times, enough to cause me to step on the break harder then intended. I didn't skid, just stoped fast and short. I was pulled over, questioned, field tested, I had even passed 2 field sobrity tests. I was then arrested, for suspision of driving under the influence of drugs. They claimed probable cause... because my eyes were red and sneezing seems to effect depth preseption. This allowed them to search my car without a warrant or permission. I explained that I had been sanding sheetrock patches, AT WORK. Didn't matter that I had dust on my cloths and hair, dried wall mud on my face and hands. I had my tools and a bucket of joint compound in the car with me.

No, there is a world of difference between home and car searches.
And your state is still bound by the US constitution. While the "nervousness" bullshit is used with some success, the bigger problem is people consenting.
You can do nothing about cops lieing and searching despite your refusal. You can do something about your consent.
Not that I disagree with your feelings of outrage that incredibly subjective things like nervousness can be used for probable cause, when highly sophisticated and controlled measures of nervousness are disallowed as evidence like polygraphs, but I think it should be said that you should not feel "hopeless". I've refused searches many times to very good effect. Out of the four times I can recall right now, only once did they search anyways, and that was a drug dog that alerted on nothing.
Saying "No" and "lawyer" works. Do it. Its the only thing you can do.
