In hindsight, things could have been done differently by the Perkasie Police Department when  Michael Marino Jr., 26, was shot to death June 9 in Sellersville  , but the shooting is legally justified, Bucks County District Attorney David Heckler said Monday afternoon.

“None of it is criminal,” Heckler said of the officers actions. “None of them had any thought but that this was going to be a routine situation in which they were going to get this kid to a hospital until all of a sudden he starts flailing with some remarkable effectiveness.”

Marino was unarmed when he was killed.

He was under the influence of drugs at the time and had been involved in previous violent incidents, including one in March of 2011, during which six police officers were sent to the emergency room after an incident in which a Taser was used on Marino by officers, but it had limited effect, Heckler wrote in a 10-page report on the shooting.

Marino was handcuffed when he was shot one time by Officer Seth Mumbauer, but Mumbauer believed Marino may have freed one hand, Heckler said. Investigators concluded both hands had been handcuffed, Heckler said.

An attorney for the Marino family has been notified about the decision and a lawsuit is expected to be filed, Heckler said.

Mental health issues play into the case, Heckler said.

“Under the circumstances as we have found them, I believe that to prosecute the officer who shot Marino would be to make that officer a scapegoat for those who decided that Marino could be free without supervision; it would be to make that officer a scapegoat for society’s choice to cut corners and hope for the best where the mentally ill are concerned and for society’s decision that when things don’t go well with the mentally ill, we’ll let the criminal justice system handle the mess that follows,” Heckler said.

Police Sgt. James Rothrock, the on-scene officer in charge of the three responding officers, is a trained hostage negotiator and has had Crisis Intervention Training, Heckler said.

Rothrock told Marino he did not want to arrest Marino, but that Marino had to go to a hospital, which Marino refused to do, Heckler said.

I hope his family gets the restitution they deserve. Just because he had a violent past doesn't mean he is Houdini, practically nobody can get out of handcuffs.

I wonder what his fellow cops did when he blasted that guy? Do you think it was like "JESUS CHRIST MAN, WHAT THE FUCK IS WRONG WITH YOU?" or do you think it was more like when you need to cover up a crime and all your buddies immediately help hide evidence and come up with a plan? Why do cops even bother investigating when they always side with the cops? It must be a PR thing...

Yeah, I can just imagine one cop shooting him and the rest just freaking out over it. And then of course once the shock has worn off it's all justified.

The cop broke the law, and regulation by shooting someone who wasnt posing IMMEDIATE threat.

Cops are allowed to draw their weapons any time, but they are not allowed to shoot someone unless they are offensive. Someone running away is not being offensive.
Its a straight up, cowardly act. No ifs ands or buts about it.

I'm not one of these people who is so quick to blame the police either, because they are just people doing their thing, much like us. They just want to make money to support themselves and their families, and so they do their job..
But, certain people, when given power, get that ego trip (its hard not to) and some people just should not be in that position..

I dont understand what your thought process has to be, no matter what this person has done in the past, to see someone running away from you, to shoot them in the back. Especially when you have plenty of armed backup.. Fucking ridiculous.. A complete waste of human life, no matter how frivolous it may have been..

no. they are only allowed to shoot someone if that person is armed and shooting first or the person has a weapon that can kill the cop with. basically only if the cops life is in danger, but can't for someone being just offensive.
