Sucks so bad man. But honestly you have so much to lose as far as your kid and family......its beyond me why someone would have dark tint which is an invitation to be pulled over then carry separate bags of shrooms and weed and pipes and a scale???? Come on dude. I really hope a judge will be lenient on you but I think it goes without saying you should a realignment of your priorities is due. Think about your kid if nothin else.

i didn't read most of the replies but, if your caught with a decent ammount, seperate bags and scales, your getting done for trafficking or intent to distribute. you can't really argue your way out of that

if you have three bags of pot, each one with a different strain, all for personal use...sure you're getting charged with intent, but you god damn better believe you can fight that shit. Explain it to the jury. I don't wanna mix my shit up, I got a bag for each strain, there IS NO EVIDENCE OF ME DISTRIBUTING!!!
You have to have evidence to get a guilty verdict, even if you don't need evidence to charge someone with intent.

well if it was just groups of different strains, that might not be so bad, but if it was all weighed out into grams or something, then obviously thats an issue.
problem is that i think the OP got caught with one big bag of shrooms and other seperate empty bags, plus scales. i may have that wrong i dunno. but if thats the case, its pretty difficult to argue out of a trafficking sort of charge when he has scales, seperate bags and a decent ammount of shrooms all in the one place.
again i really don't think this case will go to a jury. either it will be dealt with in a low level court/drug court of some such, or OP will negotiate a guilty plea with the prosecutors to lower his charges and probably lessen the severity of his charges. i think jury related considerations are irrelevant in this instance

Sorry to hear about your misfortune OP.
How much did you have? Every case is different, but I know someone who got caught with an ounce and a half in seperate bags, a scale, and a pipe. He was shitting his pants, but at the preliminary hearing plea bargined down to a disorderly conduct. No jail, no probation, and no criminal record. So I hope you will get a break too.

We have our preliminary on monday. I got myself a nice shirt, tie with my school logo on it, and a nice pair of slacks.
It was I think 3 bags, they all had mushrooms in them, but no uniform weight or anything. The 3 bars were about 2 ounces of chocolate each. All together it is less than a half pound, even considering the weight of the chocolate. So there may be no way to convince anyone that it was for personal use, scale is to measure doses as a responsible user should, etc. Well I guess we will see what happens. I would love to draw it out and try to get it dropped some how, but the bottom line is I cannot afford it. I can't afford taking the all day trips up there, I can't afford court supervision and house arrest. I can't pay my bills, can barely pay my rent. Already sold all my stuff that is worth anything (except this netbook). I just got student loans, about $5k......all gone. Had to repay my mom and grandma for the bail money they loaned. And was only able to pay them half for now because I just don't have the money. This situation will put us on the streets if it goes on much longer. Worst part is I live 10 hours away from anyone I know, so I have no help here. Isn't it fucked up how the consequences of breaking drug laws is WAY more damaging than the drugs themselves. They basically took one guy's mistake (that didn't harm anyone, and in fact helped me greatly) and caused it to destroy his family's life and future hopes. This world we live in is a nightmare, or hell on earth.......
Anyways, I will let you guys know what happens on monday. Thanks for the comments and the support. I appreciate all of it.

Oh trust me I'm going to keep my opinions to my self during the legal proceedings, but you have to admit how evil the legal system is. If we just accept that it is the way it is and there is nothing that can be done about it, then nothing will be done about it. Fact of the matter is, there is no way anyone can justify the prohibition of a natural plant or fungus that grows from the earth. It is wrong. America is not free, we are as free as the power structure allows us to think we are. I think more of us need to take an activist role in society. This situation has been a wake-up call for me. I'm not going to sit around while we are all getting fucked every day. I am going to take every opportunity that I can to get the truth out in the open. Public opinion might be shifting in favor for pot, but what about other natural substances? Who will speak for them?
And it is bullshit that my whole family is being destroyed over some natural medicine that has done nothing but improve my life over the last few years. The damn law is the only BAD thing about it. Its time to stand up, due our duties as citizens, and do away with the injustice.

ITheres good and bad in your story. First of all you need to worry about apperance...buy a suit, clean shaven face and dont shorten your hair too much. Your lawyers defence is probably going to be - no probable cause. - he has a kid that he has to spport...etc. Yes you had a scale because you dont want to get ripped off. It was in seperate bags because it was given to u like that..Blah blah im predicting and so dont think im telling u to say that cuz im not... And u use cuz of depression right?

i usually hide drugs that i drive with in that outside petrol flap thing, or i push my side mirrors all the way to one side and slide it behind the mirror etc. obviously this wont work with big ammounts of shrooms and things, but you can hide powder baggies easily in these places

That's not a good idea #4. If a pig has no probable cause to search(and you know your rights and refuse a search) your car he still might run a dog around the outside and if you got chron in those spots you're lit. While traveling keep the kron vaccum packed or in one of those anti-stink bags INSIDE your car.
This is what I hate about tinted windows, I want to fucking get them but it's a cop magnet and it could be a decent reason to pull you over because he "thought" they looked too dark. Plus crossing state lines, every state has it's own acceptable tint rating. You never know what you're getting into unless you tint your shit below every state law in the country.
Obey the traffic laws, know your rights and you're untouchable.
Sucks to hear #1, you did everything right. A lesson to all is if your driving long distances vacuum pack or 10 fold bag your weed. Why 10 fold? The smell eventually transfers out of the bag after a length in time. Or do both 10 fold bag the chron then quadruple vacuum seal it all.
On second thought you didn't do everything right. You had shrooms in multiple baggies why not in just one? I guess it didn't matter because the scale had you dead to rights.
Another lesson: If going on vacation mail your scale to your hotel or wherever before driving.

yeah I know I know. I was foolish. I guess I just got careless because in my mind, this truly is medicine. It has improved my state of being so much. I've made so much progress lately. But that is no excuse.
Well I had court on monday, and my attorney got a continuance for 30 days so he has time to view any tapes or records. I am hopeful, but another month of court supervision is going to drag us down financially. I had a job until it got destroyed by a tornado. Now the place just opened back up (I applied right after I got out of jail three weeks before they opened) and it is looking like they are not going to hire me back. Just give me the run around, even though I was a good employee, did my job well, wasn't late, didn't call in. Probably because my case is public record even though i'm not convicted. I hate this state and I hate corporations. Listen to that, I "hate" again.........didn't miss that feeling.

I'm speechless, this is an outrage of the highest order. Ruining someones life, scratch that putting an entire family in jeopardy in the name of a little grass and some mushrooms. I don't even know where to begin. Rage, hatred, an immense feeling of exacting revenge 2 fold for putting good citizens in a devastating situation which they don't deserve what so ever. This country was founded on absolute FREEDOM and the pursuit of happiness. Now it's a stinking, rotted out hole ruled by corruption, governed by purely and truly un-american laws and payed for mass media that has the population brainwashed. Fuck this country I hope the whole stinking lot fucking burns. If yellowstone erupted today or anyday for that matter I'd be singing in the mothafuckin rain.

I really appreciate the kind words, guys. Its going to be OK. People are getting screwed over this unconstitutional bullshit every day, but you know what? More people are waking up. I am pretty confident at this point that my woman's charges are going to get dropped and mine are going to get reduced. It is costing SO MUCH money and really ruining the plans we had, but maybe it happened for a reason. Maybe it is happening to make me a stronger activist. If that is the case, it succeeded. I am willing to devote my life to rehabilitating our freedom and bringing awareness to the issues that restrict it. I am going to change my major to political science and continue to law school after that so that I can devote my education to the cause.
Before this I just wanted to buy a little farm and live a secluded life while working to protect the environment. But what good is protecting the environment if the majority doesn't even appreciate it? They embrace the very causes of the destruction of natural ecosystems. I still want to protect the environment by doing my part to live a sustainable life and oppose the materialism and consumerism that is destroying our home. I will continue to promote self-sustaining practices because it is my belief that if people can learn to live without relying on industry so much, industry will shrink and the people will feel more empowered. While that may be bad for big business, it is good for us as a people and good for our planet.
For now, we can all do our part by giving Ron Paul as much support as we can. He is the only candidate that truly believes in freedom and the Constitution. The only one that will make a difference for the regular people.
