NJ man who overdosed at party to get $4M

SADDLE RIVER (AP) — A man who overdosed on stolen drugs he ingested at a party in 2007 has settled his lawsuit with a pharmacy, several guests, the party's host and the host's mother for $4.1 million.

Scott Simon, then 17, said he took Xanax that was given to him by a former employee of a Ridgewood drug store and suffered permanent nerve damage as a result.

Simon's attorney John Schepisi told The Record of Bergen County that one party guest was a former pharmacy employee who stole Xanax from the drugstore and gave it to Simon. Simon took the drugs at the party and fell into a coma.

But instead of calling for help immediately, other guests waited for a while before driving him to the hospital, his lawyer said.

Simon suffered permanent nerve damage that impaired his ability to walk and talk, Schepisi said.

"He stays at home now, trying to recuperate," Schepisi said. "He can't walk without help. He has been declared incompetent."

If Simon had been taken to a hospital right away, the injuries likely wouldn't have been permanent, the lawyer said.

Simon sued the pharmacy for not taking proper precautions to avoid the theft of drugs. He also sued several guests, the party's host and the host's parents, who were away for the weekend.

All of them will contribute toward the settlement except the host's father, who wasn't living at the home at the time.

Silvana Raso, another attorney representing Simon, said her client shares responsibility for taking the drugs. But she said the case should serve as a cautionary tale for parents whose children host parties at their homes.

Now if the guy who stole them lied to the kid and told him they were .5mg when they were actually 2mg,  it would be partially the dealer's fault,  but I still don't get how you can sue for it.

And sue the pharmacy?  must they hand out a fact sheet to every person who steals drugs from them?

He DID break a law, Xanax is a schedule IV controlled substance and is illegal to take without a prescription.

Well, only caveat here is he was 17. And I imagine the person who gave him the drugs was over 18.

I bet some of you might be changing your tune a little if this were a 16 year old girl at a party where most the guests were 21+ and someone had shot her up with heroine instead of handing her pills.

Only if they held her down and forcibly injected her.

You're responsible for what goes into your body.  Nobody forces you to do drugs.  If you can't handle the peer pressure, too fucking bad.

Generally a 16 year old isn't mature enough to make those decisions. This is why in most states it is illegal to have consenual sex with a 16yo, illegal to give a minor alcohol, and additional charges can be applied when an adult gives illegal drugs to a minor.

Not only does a minor generally not possess the maturity to make said decisions, the minor lacks the KNOWLEDGE to properly use said drugs. Which is why he ended up ODing. When you decide to GIVE drugs to other people, you are taking on an extra degree of responsibility. This is ESPECIALLY true when giving drugs to a minor.

If you don't want to be responsible for that person, let them find their own drugs.

If a gunshop were to sell handguns to people without performing a background check and meeting all legal requirements, and those guns were used to commit a crime, then they would be share some degree of responsibility.

I see no reason why giving drugs to a minor should be any different, especially when the minor wasn't seeking the drugs.

Or do you think we should also repeal entrapment laws? The police should be able to arrest someone for doing something illegal, even if the police enticed them into doing it???

Now I am not saying that case was fair, or he deserved all that money, or whatever. All I am saying is people can't go around handing drugs out to minors without taking any responsibility for the consequences.

I wonder if I could sue somebody after I got sick from eating out of their trash can.

When I was 16 I knew everything there was to know about both the history and physiological effects of any drug I used or planned too, in addition to the cocktail effects. I knew better then to eat strange pills back in kindergarten, because my parents warned me that the wrong drugs could kill me.

Freedom comes at a price, and that price is personal responsibility. Americans have been gladly trading personal responsibility for tyranny under the guise of gaining a false sense of security ever since the first act of prohibition.

Maybe if the homeowners prepared the meal from food they had picked out of the trash, told you it was safe, and then fed it to you with a spoon.

Yeah, you would probably be able to sue them then.

I'm glad you were a mature 16 year old. But not everyone is that mature at 16, which is why we have the laws we have. If you want to change the age of majority from 18, pursue that, but until then those are the law's we have. And those laws specify that people in the age of majority have to use special care, and take on greater responsibility, when dealing with minors.

But you are right, it is up to the people in the age of majority to act responsibly. The person who was handing out drugs to minors without supervising their use needs to take responsibility for the consequences of his actions.

Again, I imagine you would all be singing a different tune if say the homeowners were 21+ and had obtained alcohol and was making alcoholic drinks for 17 year olds, and then one of those teens died because of intoxication. So it isn't OK for adults to give alcohol to minors, but it is OK for adults to give illegal drugs to minors?
