Click photo to enlargeJimmy Flores, 25, (right) talks with California Highway Patrol officer Tony Nunes as the officer...«123»CHICO — A man who allegedly struck and killed a Chico woman as she jogged on Oro Chico Highway just after 9 a.m. Thursday has been arrested on suspicion of felony driving under the influence of marijuana and vehicular manslaughter.
The victim, identified as Carrie Jean Holiman, 56, is a fifth-grade teacher at Olive View School in Corning. A Corning Union Elementary School District official said she has been with the district for 29 years.

She lived in the Estates Drive area, not far from where she was struck.

Driver Jimmy Candido Flores, 25, of Chico, was arrested at the scene of the crash, about three-fourths of a mile east of Midway, by California Highway Patrol officers.

Officer Tony Nunes said Flores displayed objective symptoms of being under the influence. "He also reeked of marijuana, and his tongue was green," Nunes said.

Officials are investigating ties Flores allegedly has to a medical marijuana grow in Butte County.

Flores claimed he was driving east on Oro Chico at about 35 mph when one of two large dogs in the car jumped on his arms, causing him to swerve to the right and strike Holiman.

The driver said he believed the dog was trying to reach a window to bark at something that caught its attention.

Nunes said he had no proof the dog wasn't a factor in the tragic accident. "Regardless of that, we have to go with the impairment," he said.

No witnesses to the crash were located.

Nunes said Flores claimed to have grown up in Durham and knew the local roads. He said he thought he had seen Holiman jogging in the area on other occasions.
Flores told investigators he noticed the jogger Thursday morning, and said she was running close to the traffic lane. Nunes said an on-scene investigation showed that Flores' vehicle traveled about four feet into a gravel shoulder and said the woman appeared to be well off the roadway.

Investigators said Holiman's body was thrown about 100 feet, and have some doubt about the speed Flores said he was traveling. Flores has a previous felony DUI conviction, the CHP said.

He was booked into the Butte County Jail in Oroville on charges of gross vehicular manslaughter while intoxicated and causing injury while driving under the influence of alcohol or drugs. His bail was set at $215,000.

its not that they screw people its how easily they are allowed to majority of cops and judges good, but they can be easily useless if another judge is lopping supporters/socials heads off

they didnt say keep your 150 pound animal with the capacity of a small child in the back seat they say 'dont smoke the grass and maybe you drive stiffer like normal people:thumbup:'

Cops are actually trained to look for that.  I had a party once where my roommate invited a bunch of his high school buddies from way up north.  One of them happened to be a cop (Roommate didn't tell me this fact until many hours after they arrived).  We were playing poker in the living room, and I pulled out my dugout and poked a few one hitters.  After I finished, he asked me if he could see my tongue.  I thought it was a weird request, but I stuck it out anyway.  He looked at my tongue, and said "That's weird, pot smokers tongues are supposed to be green.  How often do you smoke?"

I thought it was weird at the time, as many of my friends smoked, as well as myself, and I never noticed anyone with a green tongue from pot...

I don't think it really matters exactly why he hit her.  There should be no distinction made between him being drunk, high, tired, not paying attention, fucking around with his dog, or any number of other possible distractions.  They are all choices he made and this woman died as a result, which means he needs to be held accountable.  How he is held accountable is what's left to decide.

This guy probably wasn't high enough to be a danger. It is possible, but you truly need the most minimal tolerance and smoke a lot of bud in a real short time.

The fact that this man's tongue was green sounds like bullshit to me. If it was he was probably eating a lollipop. Pot smoke doesn't make your tongue green because pot smoke is grey/black, the color of carbon. Derrr.

It's tragic he won't get a fair trial just because he was high. I bet you good money the state won't give him a chance to show he can drive high through some sort of controlled driving experiment. Because that would settle it, so we can't have that.

I feel bad for the woman too. But the story of the dogs is entirely plausible, especially going 35mph. It seems less likely that you'd accidentally hit somebody at that speed unless you were distracted. I mean I've definitely driven high at that speed and it ain't no marathon.

Well if you're not concerned with the conditions surrounding the crash then why not prosecute the dog? Because the dog isn't competent to stand trial, right? Since you took into consideration that condition why not the rest?

Unless you can show this man needs to be deterred from driving high because it caused the crash, the only reason to prosecute is for revenge which doesn't satisfy anyway. Maybe if every murder victim's family got a sheet of blotter this would become better understood.
