The Brazilian government authorizes the use of a hallucinogen for religious purposes
The drug has been used for years by the Indians of the Amazon
JUAN ARIAS | Rio de Janeiro  Feb. 8, 2010

The Brazilian government has authorized the use of a hallucinogen in religious rituals after years of
discussion and controversy. The liberalization of the drug called ayahuasca, or hoasca daime, used by
the Indians of the Brazilian Amazon in their rituals, has just appeared in the Gazette.

Is it legal hallucinogen use only, not marketing. There are no restrictions, anyone can use it: men,
women, even pregnant women, youths and even children, where during a religious rite. But it is
prohibited to leave the place of religious ritual while not hallucinogenic effects have passed among the
faithful. This requirement arises because there have been cases of people poisoned with this drug, and
outside the religious environment, have come to suicide.

They have been years of discussion, analysis and polemics of an expert commission established by the
government: lawyers, doctors, psychologists and sociologists, before they reached the legalization of
ayahuasca in religious communities in Brazil.

Both Eduardo Suplicy, Senator of the Workers Party, as Fernando Gaber, Green Party senator, have
applauded the decision by the Lula government, saying it is "the recognition of a truly Brazilian
religions."

The two major religions in Brazil make use of hallucinogenic tea are the Santo Daime and the Union of
the Vegetable. The first has 5,000 followers and is present also in the U.S., Spain, United Kingdom and
Canada. The Vegetal Union has 15,000 faithful in Brazil.

The most contentious part of the Government's decision is that it leaves the responsibility for what may
happen with the effects of the drug to the faithful of the community without being required to first
undertake a medical consultation, as is done for example , with whom he wants to use a gym. Because
this is a strong hallucinogen that can lead to severe damage in people who are not healthy and balanced
enough to use it.

Another fear raised is likely emergence of new religions or sects that want to use, for example, cocaine
or marijuana in their rites. "They could ban it after the liberalization of ayahuasca for religious
purposes? In Brazil, found a church is a matter of three days. Just take a charter and acknowledged
before a notary.

I was under the mistaken impression that ayahuasca was already legal in Brazil for religious purposes just as it is in many countries of the world including the USA, or parts of it.

The debate will continue whether plant based sacraments should be available to everyone for any reason or just for use in religious ceremonies.

Personally, I believe these preparations are of better use to people in a religious atmosphere, or as an aid to spiritual growth or insight. And, at the same time, I think they should be legal to everyone to use as they see fit. But, people also should be held responsible for their behaviour while under the influence, should they become a danger to themselves or others.

The Brazilian government has authorized the consumption of the hallucinogen in religious rituals after years of discussions and polemics. The legalization of the drug, name ayahuasca, daimeu hoasca, that the Indians of the Brazilian Amazon use in their rituals, failed to appear in the Official Newsletter of the State.

Only the use of the hallucinogenic is legal, not its marketing. There are no restrictions, everyone can use it: men, women- including pregnant women-, young people and even children, whoever is there during a religious practice. But they prohibit to leave the place of the religious practice while there are still hallucinogenic effects in the faithful. This requirement comes after there have been cases of people who get intoxicated with this drug, and outside of the religious environment too, have arrived to commiting suicide

There has been years of discussions, analysis, and polemics from a commission of experts created by the Government: jurists, doctors, psychologists and sociologists, before they arrived at the legalization of ayahuasca en the Brazilian religious communities.

Both Eduardo Suplicy, senator of the Workers Party, and Fernando Gabera, senator of the Green Party, have applauded the decision of the Lula Government, alleging that it is “recognizing one of the trul Brazilian religions.”

The two most important religions in Brazil that make use of the hallucinogenic tea are the Santo Daime and the Union of Vegetal. The first mentioned comes with 5,000 followers and is also present in the United States, Spain, the United Kingdom, and Canada. The Union of Vegetal comes with 15,000 faithful in Brazil.

The part most problematic part of the decision of the Government is who has the responsibility with what can occur with the effects of the drug to the faithful of the community, without being required to first undertake a medical consultation, as is done, for example, with those who want to use a gym because this is a strong hallucinogen that can lead to severe damage in people who are not healthy and balanced enough to use it.
