Unless some sneaky law got passed by some (a lot of) pretty good watchdogs, I can't see how that charge could stick? I was a little puzzled at that one myself because if that were true - no more gardening.
But - just trying not to 'noid and see. That's the worst thing about these deals - it could even be months before the next piece gets played...

Why would it not stick?  Mescaline has been illegal for awhile now.

Since you can't grow pot and you can't grow poppies and you can't grow mushrooms, I don't see what law says that you can grow mescaline and DMT?

I thought the same thing applied to San Pedro, etc.

Yeah but I get what AR is saying - and yes, Arkansas is full of little old homesteads that still have little patches of poppies. I never worried about it until recently. The police discovered a bunch of them growing by some railroad tracks and accused someone of "manufacturing opium". They made a big deal of returning there until they were confident the patch wouldn't return and thought such a great big deal of themselves - people here kinda thought it was petty and stupid for "headlines".
We used to think small patches were not a problem and kind of an Arkansas thing, but now we are more cautious. I am even worried about the school gardens because nothing is sensible or safe according to history or custom when some cheap headlines and sensationalism is there to be had. Not to mention some easy money.
Not necessarily about the plants (cacti) in this case but proving intent and trying to maybe set a even more severe precedent.
You can't count on anything when a court gets involved - it can go any way and if someone thinks they have a case they have to appeal later.
You could have a perfectly harmless flower shop and then some officer take umbrage and you are not a Florist any more you are an "Opium producer...

It's not really an enforced law, probably because it would be nearly impossible to enforce and a bunch of old ladies would end up in prison and getting high on poppy straw isnt too popular.

I got some of the bunk aya. ingredients.  BBB was pretty brazen in its presentation of their products.  I don't think the guy should be harassed or sent to prison though

This is a classic case of making an example of someone. We know that he was likely operating within the confines of the law as he interpreted it.

The feds do not like anyone other than a governing body to make money off of items that people consume for recreational purposes. Part of their ability to take this stance is an old moral code that makes it illegal for the government to tax anything that keeps the poor in poverty. Unfortunaltey, they have always viewed drugs and even alcohol in this light. They ommitted all of the slaughters and street wars during prohibition times by letting us have our alcohcol.

Since BBB was operating on the edge of legality, they were a good target to use as an example. Even if he is not convicted, any other herbalis/botanist/pothead that wants to make a living by selling entheogenic substances may look at the shit he went through and think twice about it.

Some things must remain under the radar to exist withing this toltarian environment.
