Hamilton woman, 74, arrested at border on decades-old U.S. drug charge

TORONTO - U.S. Customs and Border Protection says a 74-year-old Hamilton woman has been arrested on a drug warrant issued nearly 30 years ago in New York.
CBP says officers arrested Homenella Cole on Tuesday as she arrived at the Lewiston-Queenston border crossing in Lewiston, N.Y.
Officials say Cole was at the bridge to apply for a criminal waiver that would allow her to enter the U.S. as a visitor.
A warrant was issued on April 1, 1980, by the New York City Police Department charging Cole with possession with the intent to distribute marijuana.
Cole was arrested on the outstanding warrant and is in the custody of the New York State Police pending extradition to New York City.

I'm no lawyer, but as far as I can tell...
the only other crimes that have no statute of limitations would be Class A Felonies, which include such crimes as murder, kidnapping, rape, arson and aircraft piracy.
Other crimes, such as trafficking in or sexual exploitation of children, soliciting for child prostitution, pandering or procurement of a child, the statute of limitations is 10 years.
The lesson being if you are dealing with pot, you are worse than a child molester.

i go bar hopping in lewiston all the time. its about 15 minutes from me. awesome bars but dont get pulled over there. they will find some reason to put you in jail. if they cant find a reason then they will make one up.if you see flashing lights in the rear view then starting counting your bail money

I believe that statute of limitations only apply to charges. Once charges are filed, there is no expiration of said charges. But, I'm no lawyer either so...

Maybe a real lawyer will chime in, but what you are saying does sound correct.
Either way, I find it obscene to pursue charges against a senior citizen for pot 30 years later.

More facts are trickling in. This is very disconcerting. This elderly woman is in custody and no one in authority seems to know where. Exact details of the charges against her are not known as the case is so old it is not in the computer system. She has medical issues and has had no contact with her family. I sure hope this works out okay ...

A 74-year-old Hamilton grandmother who asked for a special waiver to enter the U.S. despite an old, apparently settled marijuana bust got a trip to a cell.
Homenella Cole had gone to the Lewiston-Queenston border to the U.S., on the advice of a lawyer, to ask for the waiver.
She was restricted from travel because of a previous charge in Canada, which was pardoned, said her daughter Charmaine Cole from her Hamilton home.
But a warrant issued on April 1, 1980 in New York City for possession of marijuana with the intent to distribute remained and, with no statute of limitations, Cole was arrested.
The warrant cites 12 pounds of marijuana found in Cole’s possession 29 years ago, said a border officer. Cole would have been in her mid-40s at the time.
“She said it was all resolved . . . she had no idea,” said Cole’s daughter Charmaine from her Hamilton home.
Fighting back tears, she said she hasn’t spoken with her mother since the arrest and has received little information from U.S. officials.
She is concerned about her mother, particularly since she takes blood pressure medication. Her mom’s Canadian lawyer has had brief contact with Cole, who said she is fine. However, the family will need to find a new lawyer with jurisdiction in New York City.
Hamilton police have no record of charges against Cole in Ontario in their electronic database going back more than 25 years.
Cole was blindsided with the arrest on her third scheduled visit to border security, said her daughter, adding that her mother is a kind, generous person known to many in her neighbourhood.
She has always opened her doors to local children, Charmaine said. Children Cole babysat through the years still come back to visit.
Kevin Corsaro, chief customs and border protection officer, Buffalo division said Cole was arrested and transferred into New York State Police custody, to be extradited New York City where she will face the charges.
Ms. Cole had been charged with possession with the intent to distribute marijuana on April 1, 1980, and U.S. Customs and Border Protection spokesman Kevin Corsaro said he believes the incident involved 12 pounds (five kilograms) of the drug.
“At the border, that's not a lot,” he said Wednesday. “But in New York City in 1980, it was probably a lot.”
“We get wanted people here in Buffalo all the time,” he said. “We don't often arrest 74-year-olds with 29-year-old warrants. That's rare.”
Helen Peterson, a spokesperson for the Queens District Attorney's Office, confirmed that Ms. Cole's warrant is one of their outstanding cases.
“But as you can imagine, the records have been stored away,” she said. “Cases that far back aren't in our computer. So we're working on pulling the file.”
Ms. Peterson was not aware of Ms. Cole's whereabouts on Wednesday.
When reached Wednesday, both the New York State Police and New York City Police said Cole was not in their custody.
Calls to the Queens District Attorney’s office, where the warrant was issued, were not returned.
Charmaine said she has not been able to speak to her mom and has had trouble gaining information from U.S. officials.
“They haven’t told me anything,” she said, adding that she has no idea how long her mom will be held, where she will be held and when she will be in court.

So, I'm guessing the only way they knew she had a warrant is because of her special waiver application This is awful. I hope that poor old woman doesn't die in custody. She might not have taken a hit in thirty years for god's sake.
