Can I sue McDonald's?

So I went to pick up bud with a friend tonight cause my normal guy wasn't answering. We got the bud, smoked some and it was :vaped: then we headed out.

ANYWAYS

I stopped by McD's to get some late night munchy food, got a double 1/4 pounder and medium fry (cause I already had a bottled coke from earlier). I FUCKING CHIPPED MY TOOTH ON SOMETHING IN THE DOUBLE QUARTER POUNDER. Let me repeat that. I FUCKING CHIPPED MY TOOTH ON SOMETHING IN THE DOUBLE QUARTER POUNDER.

I felt something weird in my bite and I was like "that didn't feel right" :someguy: I then fished out a small bit about the size of a pencil tip.

I finished the food cause I was nearly done and just thought maybe the bite felt weird and that was all. But upon closer inspection of the bit, and the combination of a newly found sharp indenture on my tooth, it's definitely part of my tooth.

Fortunately I had a newly bought *clean* vial to put the bit of my tooth in. I tongued around for a while thinking it was the back outside corner of my 1 tooth (upper right last tooth). I found that there is a sharp indenture on the back inner corner of that tooth which was not there before.

I'm trying to figure out what to do now. Clearly, never eat at McD's again. But I don't have insurance. I'm going to file a complaint with them, maybe they'll pay for my dentist bills.

I just sent an email off to them saying pretty much what I said above, sans the first paragraph. I included the following picture as well as a scan of my receipt:


What should I do? Do you guys think I can get some money? Or at least get my dental bills paid?

healthy enamel is very strong your tooth may have been decayed and therefore prone to fracture regardless of what you bite into. I wirked ina dental office for three years a few times patients asked us this same question.. Whether they can sue a fast food place for a broken tooth. No dentist I've ever worked for would be on your side. I'd say it's a argument to win. People break they're teeth on acrylic metal porcelain whatever but not usually processed bone or cartilidge

Unless you have the burger, no. They take complaints VERY seriously. Be nice to the person that calls you, because believe me. They will call you. It may be some cheap corporate shit hole, but they take any kind of inquiry very seiously.

Chances are you won't get anything but a coupon to a meal and a salad.

I just called McD's and filed a complaint. It was fairly easy and quick actually getting a human being. She was polite and took all my info. Hopefully I'll be hearing back from them soon.

Yeah, once I left feedback about an experience I had at a store on their website and I received thank you emails and two calls. Along with coupons to any store for the meal of my choice and a premium salad.

I think as long as whatever you say sounds believeable, they will give you free shit.

My experience was just me trying to help some supervisor out. I ordered one burger and he saw me waiting for a "longer than normal" amount of time and so he called me over and asked what I ordered. Found out I only ordered one burger that should have already been completed. He gave me free fries apologized and that was it. So I got a glimpse of his name tag "herbert" lol.... and well I mentioned the experience in the e-mail and how I was pleased by the way he handled business.

I wasn't complaining about the wait at all, but I told them the exact situation and they were very happy to hear from me. I can only imagine how many angry people they have to talk to on a daily basis... being a worldwide company and all...

You might not be familiar with the "Eggshell Plaintiff Doctrine"

"A defendant who has caused damages in a tort is liable for those injuries proximately caused.  However, the tortfeaser “takes the victim as he finds him.”  What this means is that if the plaintiff has pre-existing condition of health at the time of the accident that results in damages more serious and costly than they otherwise would have been, the plaintiff may recover those full damages."

drinking 5 cans of soda a day for 20 years isnt causally related to the negligent act of leaving a hunk of bone inside an "all beef paddy."

the size of the metal chip would reduce your settlement. It's not like they left a quarter sized washer in the burger. Honestly that looks like kind of a small object to do some major damage.

They emailed me saying they need to get in touch with me, but that's about it. Nothing new.

Just got a call from the store manager, he was following up with me, needed some more information so they could file an insurance claim. He was very friendly.

Just got another call from their insurance company (liberty mutual I think)

She told me that McD's gets their patties from a manufacture, and without an object from the burger that actually caused the break, there's nothing McD's can say to their manufacturer to make them take responsibilty.

Their gonna send me some information, but it doesn't look like McD's wants to pay for mah teef.

If you haven't already told em you don't have evidence, couldn't you just find a piece of bone or metal somewhere and pass it off for what was in your burger? Get a steak one night, then chip a bit of bone off it or something along those lines.

Id highly suggest NOT trying to fraud them with a bone from something else. Its not worth it. The penalties are HARSH if you're caught, financially AND mentally (possible jail time).

You don't have any evidence, its over. Too bad. As I said, they take matters VERY seriously.

Remember the human finger in the wendys chili? Google search "jail for wendys finger scam" or fraud or anything of that nature. The woman got 9 years and the man got 12. They're still in jail.

ground beef always has bits of bone and shit in it, even if you buy the meat from a grocery store.  at least mine always had.  sausages, too.  better to just become a vegetarian.

Ahhh, mcdonalds...

poor poor corporate bastards they are. They love to put MSG in their shit, though. I mean what the fuck else could it be in there that makes their glue-food so damn tasty?  I ate mcdonalds twice in one day and I felt like I was dying. I have a theory they put anti-depressants in their wonderfully masked crap food as well.

Still they seem to be on the receiving end of a lot of flak they don't necessarily deserve, simply because it is a money producing machine...well, then again that is reason enough to give them hell.

Greed.  I remember once when I was a kid me and my dad ate at some McDonalds and my dad decided to take it upon himself to wrestle a huge coupon book of free food out of some manager over the course of many extensive phone calls claiming we were being made fun of by the staff.

When it comes down to basics, what is the difference between the CEOs of McDonalds and drug dealers?  Legality of their products aside, both are making profit selling a product which they know to be potentially dangerous to customers' health.

You could argue this with any CEO of a consumables corporation, whether it be food, drink, or cigarettes.  Unlike cigarettes, food and drink are not dangerous if usage is moderated, however.

Almost any food or drink, if over-consumed, is potentially dangerous to the customers' health.

I do agree that they are alike, though. They both sell things.
