Victoria Police get power to take drug-users' licences [AUS]

December 22, 2009 - News.com.au
VICTORIAN police will next year have the power to automatically suspend a driver's licence if a laboratory drug test showed the motorist was affected by illegal drugs.
Under the laws, announced today to take effect in mid-2010, motorists found to have illegal drugs in their system will face automatic licence suspension for three months and fines of at least $350.
"In the last financial year, almost 23,000 roadside drug tests were conducted with 341 offenders caught with an illicit substance in their system," Victoria Police Deputy Commissioner Ken Lay said.
"That's a strike rate of 1 in 67.
"We know there are drug-affected motorists on the roads and a mandatory loss of licence will be an extra deterrent to those dangerous drivers."
Victorian Roads Minister Tim Pallas said traces of one or more illicit drugs were found in 30 per cent of drivers who died on Victoria's roads each year.

Good luck finding that sorta info..
There's definitely no transparency as to the amount drugs they can trace in your system as many types can stay in your body for days or weeks after use.
Also their strike rate is bull and cock because they often setup roadside testing in the vicinity of large festivals and music events. I remember reading an article a year ago where police targeted a large music event and nabbed 1 in 10 drivers for drugs in their system.

I believe they can tell roughly how recently you smoke or else they just lie.
I read about a case here before. Police pulled a guy over and his eyes were glazed so they brought him to the station for a drug test.
+ for cannabis and he was brought to court. They said he was drug driving but he said he smoked that morning or the day before. They said results showed it was closer to the time they stopped him.
He was put off the road for at least 2/3 years. The drink driving penalties weren't even that harsh at the time.
That's an isolated incident though,I've never heard of that before or after.

fucking hell. if i get caught when im NOT stoned ill be so fucking pissed off. i would request a lab test, and bet that the cannabinoids they analyze would not be delta-9-thc, but thc metabolites that are not psychoactive.
but, that obviously wouldnt happen, as when it comes to and marijuana laws, logic goes out with the window. not to metion common sense.

Whether the drug is legal or not, driving under the influence of any drug should give this penalty. Why only target the people who use the illegal ones? Alcohol will cause just as much of a problem driving as anything else can so the penalties should be the same.

Exactly. Fucking stupid laws. That marijuana is illegal so lets further try to fuck over the users by taking away their license if they've smoked pot within the last month! Cause you know it stays in your body that long so you're impaired that long

I am tested so much at work in such sneaky and inventive ways Ive given up my cannabis usage for the last few years.Marijuana helps with back pain and arthritis and relaxation, I pray for the day that it becomes legal in the State of Ohio for medical usage. Laws like these are just passed by those who know it stays in the system for 30 days or longer and they know that these penalty's are not only for usage just prior or while operating a motor vehicle, they are to made directly to punish any use that has occurred in the last month and the user. This is a sneaky and underhanded attack wielded by law enforcement as a way to attack and punish the users of Cannabis FOR ANY USAGE AT ALL, and not just use while operating a vehicle AS IT IS DISGUISED,and its a great way to line the pockets of Scumbag law enforcement, lawyers and Judges and city officials, who make there living off off of these underhanded tactics while parading as the saviors of civilization and children (PLEASE)**. The legalization of Marijuana will practically bankrupt law enforcement and cut hundreds of thousands of these scumbags out of a job and will force them to concentrate on the other things they should be doing. They have and will fight legalization tooth and nail, they hate to give up there favorite most cash making pastime, harassing Marijuana users . I applaud and have much Love for these brave individuals and States that started to try to put an end to this scapegoating. And pray for the day I can toke again as free man should be able to do.

i'm pretty sure they use mouth swabs. you'll test positive if you've smoked in the last 24 hours give or take. i could very well be wrong there though. it's just what i've heard from a few different college kids.

Including coffee and ibuprofen?

Yes that is how they do it in Australia. In the US they take your blood.

In 2006 random roadside drug testing caught a total of 287 people with drugs in their system.
199 tested positive for methamphetamine and ONLY 19 for THC. 69 people tested positive to both.
Who would've thought.

my bloods gonna boil if i find out that this happens to NSW i think most of the drug tests is mostly aimed towards truck drivers and possibly drivers around festivals and such, but i could be wrong
any experiences from people from australia being randomly drug tested because i would be very interested?
also i do think they use the saliva swab

I agree with this, just as I agree with the post earlier that drugs be they legal or illegal if they affect your judgement then you shouldn't be on the road.
There needs to be a study done to how long certain drugs stay in your system and when your are considered "normal" or "sober". Similar to alchohol having a legal amount of 0.05 BAC.
As THC (or whatever the chemical is) stays in your fat cells and doesn't metabolise quickly weed smokers are unfairly targeted.

that is exactly right, but i dont think the government gives a flying fuck about THC because it is illegal.
on another note, i hear the swab is one of the easiest tests to pass, can anyone elaborate any further?
