Marc Emery in jail awaiting extradition to U.S.
 INNOCENT CANADIAN RESIDENT/CITIZEN BEING IMPRISONED IN UNITED STATES FOR SENDING PLANT SEEDS
VANCOUVER — Canada's self-proclaimed "Prince of Pot" was escorted out of B.C. Supreme Court and into jail Monday to await extradition to the U.S., where he is to serve up to five years in prison for shipping marijuana seeds across the border.
Marc Emery, 51, was indicted in 2005 along with two associates on drug and money-laundering charges stemming from a lucrative mail-order pot-seed business run out of Emery's Vancouver book and paraphernalia shop, which also doubled as B.C.'s Marijuana Party headquarters.
Two charges Emery faced — conspiracy to distribute marijuana and conspiracy to engage in money laundering — were dropped in exchange for his guilty plea on the charge of conspiracy to manufacture marijuana.
He has agreed to a five-year imprisonment plea bargain in connection with his $3-million a year marijuana seed catalogue business, where most of his customers were American.
Canadian authorities drew criticism for helping the U.S. nab Emery because he openly participated in an operation that drew little heat in Canada.
Emery was convicted in Canada of selling pot seeds in 1998 and given a $2,000 fine.
Emery's two associates, Michelle Rainey, 38, and Gregory Williams, 54, were recently sentenced in the U.S. to two years probation for conspiracy to manufacture marijuana as a result of a plea deal.
As Emery left the tiny courtroom, his wife Jody wept in the public gallery while a crowd of the cannabis crusader's followers chanted: "Free Marc Emery!"
As he was led away, he yelled: "I love you Jody Emery. Plant the seeds of freedom; overgrow the government!"
Emery will be held for 30 days to give him time to appeal and then, once the federal justice minister has signed the removal order, Emery will be handed over to the U.S.
Now dubbed the country's first "marijuana martyr," Emery recently wrapped up a 30-city "farewell tour" across Canada.
He is also hoping a transfer agreement allowing Canadians convicted and jailed in the U.S. to serve their time back home will play in his favour.
"The same seeds I sold are being sold right in America . . . There's a terrible hypocrisy at work here," said Emery. "There isn't a single victim in my case, no one who can stand up and say, 'I was hurt by Marc Emery.' No one."

This is the time to contact your state senator and even the email address of the white house. See the thread in our Pub for details on how.
1. Google your state name + senator 2. Call them (you'll get a male or female aide or voice mail 99.9% of the time) or email them 3. Be polite. Be factual. Be brief. Tell them you do not agree and you want action taken to insure his well being at a minimum. (This can lead to a transfer to a Canadian prison or better, a presidential pardon).
An example of a fast call going to voicemail would go something like this...
Hi. My name is...and I'm a resident of our state. There is a man, a Canadian resident and citizen, named Marc Emery who is about to be extradited for plant seeds to the United States. I do not agree with this. Please either allow him to go to Canada and serve his time there or request a presidential pardon.

The thing is he's intelligent and he doesn't come off as overweight, unhealthy, and without a message. He appeals to people who simply listen to others. For people who watch those government ads about eggs and frying pans that can be a little controversial. For those who know we're talking about a plant that can in fact be used responsibly like alcohol, it's really outrageous to witness this sort of thing.

The issue here is that he didn't commit any crime on American soil, and thus American laws shouldn't be applying to him. However if Canada were to hold on to him and tell America to fuck off it would probably start a lot of crap between the two neighbors.
That would be favorable for us who support legalization, but Canada surely doesn't like that idea and America, being a fucking police-country, is willing to fight to keep guys like this under control.
But Emery had the right idea - the only way to overthrow the government's pot laws is to overgrow the government. I thank him for his efforts and I applaud him for what he did even at the risk of the jailtime he has to now serve. He should know while he's in there that there's a lot of people who support his efforts!
We get one step closer to legalization every day - but we cannot give up the fight! Keep up the battle everyone, because it's your right to put whatever you want in your body (assuming doing so doesn't harm anyone else) and don't ever let government or anyone else tell you otherwise!

they held Tommy Chong they are not going to let Emery go. However I still think you should write and phone to help him.
edit: Actually there may be some legal precedence for this. If I am not mistaken Emery is the federal representative of the Canadian Marijuana party. In the early 2000s the current Premiere (similar to Governor) of BC was caught drunk driving in Hawaii. He served no jail time and was let off without punishment.

Not to come off as angry about my Premier, (But I am) but I'm certain the reason he got no jail was because he sucks good dick.

But in all seriousness. What is more harmful? Drunk driving or pot seeds? on top of that Gordon Cambell (Premier of BC) committed his crime on US soil. Marc never crossed the border. This situation is nothing less then biased and corrupt.

Yeah, that's not exactly the plan. We need to be "virtued" in a way that gives us the eloquence and facts that bring this into a more accurate light.
This is not the Final Medicine to Fix Our World. It is, however, a culturally inclusive aspect of North America and the World.
We can't just make this specific plant illegal and consider it a done deal. There's more to this instance than meets the eye of the past.

CANNABIS CULTURE - Marijuana activist and Cannabis Culture Publisher Marc Emery surrendered to Canadian authorities Monday, September 28th and was escorted to jail to await a transfer to the United States where he is expected to serve a 5-year prison sentence for selling marijuana seeds.
The 'Prince of Pot' held a press conference in front of the British Columbia courthouse where he spoke to supporters and journalists. After an emotional speech from Emery and his wife Jodie, Marc hugged many of his friends and made his way into the courtroom.
Mainstream Media correspondents were on-scene and began reporting on the event shortly after Marc was 'committed' by the judge and taken from the courtroom.

This Monday (or today thru leaving a 30 second voicemail) we're going to make calls to the Justice Minister of Canada (a regular man who puts his pants on one leg at a time like you and me). It doesn't matter if you're from Canada or not. They will take your phone call or if they're not there just leave a voicemail. The office is open from 9-5 so anytime after that you'll get voicemail.
Marc Emery was taken into custody on Monday, September 28th. Marc is being held in Canada until the Justice Minister signs the extradition order to send him to the USA. Tell the Justice Minister to refuse the extradition of Marc Emery!
Contact the Justice Minister of Canada, Rob Nicholson, to tell him that you are a voter and you want him to refuse the extradition order for Marc Emery. You must insist that the message be delivered directly to the Justice Minister, and ask for a response too!

I wrote the Canadian justice minister even though I'm a lowly American. The following is a copy of the email:

Mr. Nicholson,
It is with great anger I write this letter. What have you done with your own people? What have you done to your own citizens?
I have never seen a Canadian leader so willing to give up its own population to a separate nation. I ask you to reconsider the extradition of Canadian resident Marc Emery, a tax paying Canadian citizen. I realize the mounting pressure of a seemingly organized nation with an agressive enforcement agency has delved in and instigated this scenario. I also realize your personal position on the matter.
Can you really sit there day after day knowing you're about to extradite a Canadian citizen to America's prison system OVER a PLANT SEED COMPANY? I will ask you this with the following academic arguments in mind:
1. Is every plant on the Earth a part of the Earth or should we reject some plants that have been put here? 2. Is a seed the same thing as a chemical substance? 3. What has Nature done to us with these seeds that is so aweful? 4. Is it right for one man to imprison another over a tax-paying company that distributed plant seeds? (Shall you take taxes from a man and not give him legal fortitude?) 5. Is it easy to ship off to another nation a man whom paid you taxes and operated openly before you for a decade? (Is there truly no issue of conscience at hand here?)
I respectfully insist on a response, Mr. Nicholson. This is authentically outrageous. Neither you nor anyone of an academic nature can simply sign a piece of paper and cooly walk off. It shall not go down this way (it shall not simply be). Time will prove that - not me - based on this noteworthy event.

I wrote my senator and just now called the office of the American judge in Seattle overseeing this.
Judge Ricardo S. Martinez U.S. Courthouse 700 Stewart Street, Suite 13134 Seattle, WA 98101-9906
I called and spoke with the office and they are "getting a lot of letters" on Marc Emery's behalf. I asked if the judge has any power over the sentencing despite a plea bargain being in place and the answer was a definite "YES."

I’m writing today about a Canadian man in his fifties who is, for some strange and contrary reason, being extradited to the Land of the Free where men and women are supposed to be guaranteed liberty, freedom, and the pursuit of happiness.
This case involves a Canadian resident who is a Canadian citizen. This case began under the Bush administration and under questionable intentions.
The man involved has run a Canadian tax-paying business that once sold and mailed cannabis seeds. The man involved neither harmed anyone and if there was a crime, it was without one victim. The man involved has been openly and peacefully engaged in activism alongside his business and because of this, he became a scapegoat. He then faced enormous pressure and was absolutely forced to agree to plea bargain.
This case will speak volumes about how we bully other nations, families, and individuals both in America and throughout the World. This case will speak volumes about how we actually interpret “the pursuit of happiness.” This case, if not properly aligned, will show that you can pay taxes on your business and not receive legal fortitude from your own nation. This case, if not properly aligned, will show America is controlling the freedom of the world, a right it should not have nor want. We are proponents of freedom, not thieves of it.
You, your honor, do have the power to make this case a justifiable exception. You, your honor, do possess the fortitude to push this back to Canada.
Your honor, I ask that you send this case to Canada on the grounds that Canada did not provide Marc with a government spine despite Canada receiving faithfully business and sales taxes that exceeded $500,000 issued provincially and federally in Canada.
Please do not let Marc spend one minute in prison. Refuse the plea bargain on the grounds that extradition is not constitutional for a victimless crime. Refuse the option to federally imprison him in America for a victimless crime while a Canadian citizen and resident. Refuse the extradition entirely.

I live in van, I've smoked with Marc many many times, and yea, he's a creeper (wraps arms around girls and such) and he's kinda odd (he'll throw a bud into the bowl, torch it with a jet lighter, and then throw the rest of the bud, only hairs and outer crystals for Mr.emery sometimes it seems xD) but it's total bullshit to throw him in jail for selling seeds specially when the last time my friend got seeds, he ordered them from Cali! (they didn't have og kush in at the time, and it was cheaper to online then buy in another store) I call shenanigans!!!

Emery is replacing her husband as sole director of Avalon Sunsplash Ltd., the parent company of Cannabis Culture, following his arrest last week.
Marc Emery was taken into custody at B.C.'s Supreme Court Sept. 28. He faces the possibility of extradition to the United States on charges of conspiracy to manufacture marijuana and is expected to plead guilty in return for a five-year sentence.
A previous licence application to the city for the business at 307 W. Hastings St. was denied last summer, in part because of her husband's previous convictions on drug-related charges.
The new application should be filed within the next two weeks, according to Emery, who said she's "almost 100 per cent certain" the application will go through, as the majority of city council's problems with the business concerned her husband's involvement.
Emery doesn't have a criminal record, she said.
A search of B.C. court records did not turn up any charges or convictions against Emery.
Council can refuse licence applications if the applicant has been convicted of a crime within the past five years, particularly if the crime relates to the proposed business.
Emery is also maintaining her political career as policing critic for the Green Party of B.C., and is slated to run in the Vancouver South riding in the next federal election.
She said the campaign is intended to inform the public about her platform, not necessarily to win seats.
"I'm not running to get votes. I'm running to get the message out," Emery said. Avalon Sunsplash's additional business application for the 420 Convenience Store at 316 W. Hastings St. was denied, and the store was shut down, last year.
The company withdrew an application for the Hastings Pot Block's upstairs administrative offices last July because there was no need for a business licence for the political headquarters of the B.C. Marijuana Party, according to lawyer Kirk Tousaw.
Tousaw, who is representing Avalon Sunsplash, said he expects the licence for Cannabis Culture's retail store to be approved.
"I can't think of a reason why the city would refuse a business licence," said Tousaw, who is also executive director of the Beyond Prohibition Foundation. Cannabis Culture attracts tourists and reflects the culture of the Hastings neighbourhood, according to Tousaw.
He added that there are at least half a dozen similar stores in Vancouver. "Tourists leave, maybe having bought some hemp clothes or literature," Tousaw said. "I don't think the city should be in the business of [restricting commerce]."
Vision Coun. Geoff Meggs said city staff would review the application when it comes in.
He added that he does not have any reservations about the licence application right now but will form an opinion once staff has presented the relevant information to council.
"I can't say I have any at this point, not knowing anything behind it," Meggs said.
Marc Emery's lawyers are filing a submission to fight his extradition to the U.S. Tousaw said it could be a month or more before a decision is made.

Selling pot seeds is legal in Canada. if emery was illegal, so is pretty much EVERY SHROOMERY SPONSOR. he didn't sell the pot seeds to grow, he sold them for people to make hemp seed extracts and such, RIGHT!?!?!? right. just like all the grow logs here were done from mushrooms they just had growing around, with no knowledge of their legality. and they ordered the spore syringes from the web to study under their microscopes. EVERY SINGLE PERSON. NOBODY GROWS MUSH OR POT FOR ILLEGAL USES, ITS ALL ACCIDENTS. Shit man, that seed totally wrapped itself in wet paper towel and germinated then planted itself man! fuck! Some of the states in the US have medicinal marijuana growers. Even if the intent was to produce marijuana, it is not necessarily illegal.

I know and that's one more thing to add to this.
Do you agree that there's as many types of cannabis users as there are coffee users? We do have assholes in our group. But we also have a lot of nice, intelligent, normal people too. Unfortunately, the latter hasn't set the trend and marked the identity and culture of cannabis.

I look like a biker and haven't touched the stuff in years.
I just don't see the moral difference between MJ and dozens of legal herbs, that can be found at so many box stores.
I've heard that, when molasses, tobacco, and tea were contraband, they ripped apart houses for those, too.

Barely anyone shows up to these rally's in Canada so I wouldn't be surprised if barely anyone shows up to this. Why waste your time to accomplish nothing when we need medical marijuana as well as legalization in our state? Have a good time however I won't waste my time on this.'
It's pessimists like this that are letting the side down. Sure, what this guy is saying could be true with regards to the action/protests possibly not leading Marc out of prison but he's missing a point; the unity of smokers making their voices heard, gaining greater publicity to the masses has to be a good thing. This alone is making more and more people aware of what is happening and the injustice being served (and hopefully even the moral issues regarding the criminalization of cannabis). If everyone was to do as this guy is and shut up on the grounds that it will never get anywhere then it never will get anywhere.
