Bill to Ban Salvia Divinorum Proposed in Maryland [MD] (Help me fight back!)
#9628089 - 01/17/09 06:21 PM (3 years, 28 days ago) |

On January 14, 2009, Senator Richard Colburn (R) introduced Senate Bill 9 to the Maryland State Legislature. If enacted, this bill would make Salvia divinorum a Schedule I controlled substance in that state. The text only mentions Salvia divinorum it does not mention salvinorin A. Source: http://www.sagewisdom.org/legalstatus.html
I have already made a similar post about this issue in Security and Safety ( http://www.shroomery.org/forums/showflat.php/Cat/0/Number/9621170/an/0/page/0/gonew/1#UNREAD ) and after receiving advice, have decided to raise alarm about this issue in attempts to gain backing in contacting State Legislature in stopping this Bill from banning the entheogenic herb Salvia Divinorum.
We have until I believe Tuesday, January 27 to fight this issue before it leaves the Committee level!
Simplified versions of the situation regarding these bills can be found here:
House: http://mlis.state.md.us/2009rs/billfile/hb0008.htm Senate: http://mlis.state.md.us/2009rs/billfile/SB0009.htm
These bills are sponsored by: Delegate: JEANNIE HADDAWAY-RICCIO Republican, District 37B, Caroline, Dorchester, Talbot & Wicomico Counties

Delegate: ADELAIDE C. (ADDIE) ECKARDT Republican, District 37B, Caroline, Dorchester, Talbot, & Wicomico Counties

Senator: RICHARD F. COLBURN Republican, District 37, Caroline, Dorchester, Talbot & Wicomico Counties
James Senate Office Building, Room 315 11 Bladen St., Annapolis, MD 21401 (410) 841-3590, (301) 858-3590 1-800-492-7122, ext. 3590 (toll free) e-mail: richard.colburn@senate.state.md.us fax: (410) 841-3087, (301) 858-3087
Dorchester County: 5210 Heron Road, Cambridge, MD 21613 (410) 228-1137; fax: (410) 376-3737
Talbot County: (410) 819-3337
I apologize if I am going about spreading information about this issue the wrong way, but I honestly don't know much about trying to fight back against legislation. What I DO know is that if these bills pass I will be in possession of enough Schedule I substance to be falsely deemed "Intent to Distribute". I and thousands of others use Salvia Divinorum for an entheogenic (spiritual) purpose! Salvia is not a party drug, not addictive, and has medicinal and therapeutic potential which out-rules it from being a Schedule I substance. THIS IS AN OUTRAGE AND A VIOLATION OF OUR RIGHTS! Help me contact Maryland legislature and fight back against this rediculous "War on Drugs" and violation of our rights.
Please fellow members of the Shroomery. I can only do so much on my own. I need your help in making sure no more of our rights are stripped away... Thank you and administration: I apologize if I have gone about posting this in the wrong way. Any advice is GREATLY appreciated.
Official drafts of these bills can be found here: For House: http://mgasearch.state.md.us/data/2009rs/bills_noln/hb/fhb0008.pdf#xml=http://mgasearch.state.md.us/search97cgi/s97is.dll?action=View&VdkVgwKey=j%3A

Thanks for keeping us advised of this proposed law. I will sticky this post until January 26 to allow as many of our Maryland readers an opportunity to see this and help you in your efforts. Good luck.

Thank you, that is extremely appreciated! I am in the process of sending out e-mails to NORML, DPA, ASA and MPP as recommended by Alan Rockefeller in a seperate thread.
If administrators, moderators, or members are able to lend any effort, guidance, or advice it will be well appreciated and well used.
I am glad to see the Shroomery come together to help out a fellow member and his legal jurisdiction.

Unfortunately the Maryland State House in Annapolis... long, long trip for me... So far I've posted notices on just about every corner of the internet relating to salvia, drugs, ethnobotanicals, entheogens, and such. I'm trying my best, but one man can only do so much. We need more help, more voices. Spread the word as best you can!

Maybe Cali will be the only one to resist, even when it's a federal law.

Our friends at the SalviaSource.Org have taken up arms in helping me fight these proposals and have notified the Sagewise Group and the Outward Journey Forum.
Hopefully we will be able to raise resistance against these proposals in the countdown to the legislative meeting on January 27th.

Daniel Siebert's letter template for others to use and mail to their state's representatives can be found here: http://www.salviasource.org/includes/letters/letter%20template1%20-%20daniel%20siebert.htm
Please use this in writing letters, e-mails, or format for a speech to be presented to legislation.

Politicians generally are concerned about their careers and looking good, which usually means seeming tough on drugs. I would go about this with a few fronts.
First: Take an hour or two to scour the internet for research and information. Siebert's letter, linked above, is really good. Also check out Google, PubMed, Google Scholar and other sources. Compile as much valid research and personal anecdotes and statements as possible.
Second: Get in touch with the key players. People and organizations that could be impacted by this legislation. This would definitely include medical organizations, mental health organizations, public health, etc. Unfortunately there is little time for this, so you'll have to move fast. Send their directors your research and a maybe a cover letter or something explaining why they should be concerned about this, and ask for their help. The goal of this is to build and demonstrate support for not passing this bill.
Third: The media. Contact all the big and small media sources around the state. Send in letters to the editors, and try to call and speak with reporters and editors and encourage them to be true to their credo and report objectively. This is an important issue. Legislation is about to be passed to outlaw and criminalize an herb that has medical potential and DOES NOT FIT THE CRITERIA FOR BEING SCHEDULED INTO Sched. 1. Get the media involved!
Fourth: The politicians. If you can, go to the committee meeting. If you can't, call your representatives, ask to speak with them directly, or otherwise explain your position. Urge all your friends and family to do the same. Send them the research you've done and a short letter explaining your position. Tell them why they shouldn't outlaw Salvia. Urge them to read the text for schedule one and see if it actually meets the criteria (it doesn't). Ask for them to simply let the legislation die. At the most, salvia should not be scheduled above Sched. 3.
E-mailing and getting in touch with those other organizations is good, but unfortunately, their resources are limited and they do have priorities. You will need to do some heavy duty work for this. But it's important and it's worth it.
Good luck! Feel free to PM with questions or whatever.

Nothing irritates me more than the very common and popular conception that if it's man made and doesn't get you high (other than for pain or mothers helpers anti anxiety...which they "need") then it doesn't have a chance.
Look who founded America......crazy Christian Pilgrims afraid of the "heathen ways".
It is fucked up what really goes down in this country, how Pharmi's are advertised as God's gift to earth and plants are demonized as the next teenage menace.....hell, at that age anything is a menace; cause they are.
