Growing marijuana at home means jail time for a Minto man.
Judge Patricia Cumming sentenced Darrell John McKiel to two months behind bars when he appeared in Burton Provincial Court yesterday, citing that such activity has to be discouraged.
The 43-year-old pleaded guilty to growing marijuana when he appeared in court Nov. 3.
Crown prosecutor David Hitchcock told the court that McKiel's home was raided by the RCMP late in the afternoon of April 8.
McKiel tried to "rub the plants" into the soil when police arrived, and had to be handcuffed, Hitchcock said.
Officers found cigarettes, marijuana seeds and about 13 plants in a pair of trays.
"These were only two to three inches high," Hitchcock said.
There was no timer or special equipment -- just plants growing under a light, court was told.
"It was a most unsophisticated type of grow," Hitchcock said.
The Crown prosecutor asked the court to send McKiel to jail.
"Grow-ops by their very nature demand incarceration," he said.
Defence counsel Ed Derrah said McKiel intended to use the plants to relieve pain associated with a serious ATV accident that occurred a number of years ago.
But Cumming wasn't buying it.
She said it was obvious that McKiel was willing to do whatever he had to do to keep police from finding the pot.
Cumming said the grow-op may not have been a sophisticated one, but pointed out that such activity is prohibited and illegal.
Had it been a more serious situation, Cumming told McKiel, he could have found himself spending the next seven years in jail.
