Cops: 3 planned magic mushroom farm in Morris Twp. home

Two men and a woman have been charged with trying to set up an illegal mushroom growing facility at a home they rented on Delmar Avenue.

A search warrant was executed Tuesday at 9:30 p.m. at 23 Delmar Ave by township police after a short term undercover operation that was conducted by Morris Township Detective Brian Markt and the Morris County Prosecutor’s Office Special Enforcement Unit.

The operation targeted the Delmar avenue residence which was being rented and occupied by three individuals, who were setting up a manufacturing facility for the cultivation of psilocybin mushrooms, according to a release from the prosecutor’s office. The property owners were not aware or involved in the alleged activity, the release said.

The production facility included a secure room in the basement that had been modified to accommodate the elaborate grow operation, the release said.

The investigation revealed the three suspects planned to grow the illegal mushrooms and then transport them to Pennsylvania and other areas for distribution. Seized from within the residence were all of the necessary items to carry out the cultivation scheme, the release said.

In addition to the items related to the production facility, marijuana and related paraphernalia along with approximately $900 in cash was seized.

Christopher Donahue, 24, and Phillip Polynone, 23, both of Morris Twp., were charged with criminal attempt to operate a controlled dangerous substance production facility; conspiracy to operate a controlled dangerous substance production facility; possession of marijuana and possession of drug paraphernalia. Bail for Donahue was set at $100,000 while Polynone’s bail was set at $75,000.

Stephanie Avitable, 23, of Morris Twp., was charged with criminal attempt to operate a controlled dangerous substance production facility, conspiracy to operate a controlled dangerous substance production facility, possession of marijuana and possession of drug paraphernalia. Her bail was set at $75,000.

“We moved on this operation quickly before the manufacturing process became completely operational,” Morris County Prosecutor Robert A. Bianchi said. “I am extremely proud that the operation was infiltrated and neutralized before any drugs were able to be produced and distributed.”

Bianchi said the key break in the case was the result of increased vigilance by ordinary citizens who saw something out of the ordinary.

“It is the team approach by both private citizens and law enforcement that ultimately makes a difference and allows us to maintain the quality of life that we all so rightly deserve,” Bianchi said.

The Morris County Sheriffs’ Office K9 and Criminal Investigations Section assisted the Morris Township police and the Morris County Prosecutor’s Office during the investigation.

Police Chief Timothy Quinn said the investigation was “a text book example of how the joint cooperation of law enforcement agencies can react quickly to dismantle, and prevent, what was going to be a major distribution of narcotics.”

so they are in jail on 75,000 dollars bond for having nutrients and plastic tubs in thier houses? If it wasnt operational then the most they would have would be prints/spores, other than the bag of grass and pipe the chick had on her...

Im pretty sure its gotten the point in this country that you could just make a crime called "Conspiracy to _____" and you can go to jail for it. No matter how little actual evidence they have, they can get you on conspiracy for shit. The patriot act is the catalyst for the final destruction of America.

If they get a lawyer that isn't retarded they'll get off on the "Attempt" charge. Fucking ridiculous... What backwoods bumfuck law enforcement agency busts something before it happens? Thank god they live in an area with developmentally disabled police. I can't wait until police chief Fuckwad learns that arrest doesn't equal conviction.

Thank god the real estate debacle and 700 billion dollar bailout will so strain federal coffers and near-bankrupt every state such that it may finally have a chilling effect on the tendency of the federal and state governments to throw every non-violent drug possession victim in jail  because it's just too much $$$ to prosecute and incarcerate 'em.  In the desperate search for revenue, progressive states might even decriminalize pot and tax it like alcohol, cigarettes and gasoline.  :thumbup:

there could have either been an informant, one of them said something when they got caught, written evidence laying around like addresses and "to send pot to" written next to them or something, or hell even a phone tap.

but yeah this article isnt very clear on the statistics.
then again if u want the raw story you would probably have to ask from the dude who got arrested himself, as any news reporter is going to fuck it all to smud.

I would never start any kind of elaborate grow with 2 other people. Or even show anybody i know personally my setups and shit. And if i were going to sell (which i don't) i would have people meet me at different places all the time. Never my own home. Never trust ANYONE!!:crazy:

I don't know about this nationwide but in Oklahoma miranda rights are no longer read to people getting arrested. I asked my attorney about it and he said the requirement was discontinued because to many people used it as a way to get thier case dropped.

Yeah! If they didn't see any mushrooms or weed before the cops planned on showing up there rights were stripped from them illegally. There was no grounds for an investigation either from what the story says. Just because a neighbor says something it doesn't mean that it is true unless they said they did see illegal products. If they lied about that then the case will be thrown or they will get off with a paraphernalia charge for the weed. Thats it if they get a smart lawyer. The lawyer could even help them press charges against the "citizens" for lying to law enforcement. Especially if that sole reason was the reason the judge provided a search warrant and they were not actually growing drugs yet. But then as some said if they gave themselves up by admitting to it they are screwed royally.

I do not see how this could be true. Miranda vs Arizona was a supreme court case, and as such it should apply equally to all 50 states.

yeah, and Chief Timothy Quinn seems to like to use fancy big boy words without any idea what they mean.  Mushrooms neither are nor contain narcotics.


It's hard to imagine a drug that could be more removed from a narcotic than mushrooms.
