Garden Grove to consider ban on pot dispensaries

Although there are no dispensaries operating in the city, officials say they don't want any sprouting up in the future and causing problems in the community.
A vote from the City Council Tuesday night could nip the future of pot dispensaries in Garden Grove altogether.
Council members will consider a municipal ordinance that would make it illegal to operate a medical marijuana dispensary in the city.
City staff members, especially the police department, are recommending the ban because they say the presence of dispensaries would increase crime and drug abuse.
City Manager Matthew Fertal said this is the first such ordinance to come before the City Council.
"We've observed that whether it's hookah parlors or other facilities like that, there are always problems associated with those places," he said. "We just don't want a situation in our city where these dispensaries cause problems for residents and surrounding communities."
Some Orange County cities with moratoriums or permanent bans on pot dispensaries include Buena Park, Fullerton, Mission Viejo, Santa Ana, Tustin, Huntington Beach and Placentia. Laguna Woods last week became the first local city to pass an ordinance allowing medical marijuana dispensaries.
The city of Garden Grove is in the midst of a medical marijuana case involving pot police officers confiscated from Felix Kha, a medical marijuana user, during a routine traffic stop. Kha won the case in the lower court and appellate court. Both courts ordered the city to return Kha's marijuana. The California Supreme Court also declined the city's appeal to hear the case.
The case over three-eighths of an ounce of marijuana is now before the U.S. Supreme Court. Joe Elford, who is chief counsel for Americans for Safe Access and represents Kha in his action against Garden Grove, said such bans by cities are antagonistic to state law, which allows the use of marijuana for medical purposes.
"It's easy for law enforcement agencies to say that medical marijuana dispensaries attract crime," he said. "They may have one or two anecdotes to back that up. But so far, I've never seen any statistical evidence."
Elford's group has filed lawsuits challenging similar ordinances in Fresno, Concord, Susanville and Butte County.
Garden Grove Councilman Mark Rosen said he will listen to what community members have to say Tuesday, but is leaning toward approving the ordinance.
"If we're the only large city in the area that allows these dispensaries then everyone who wants to buy marijuana is going to end up here," he said. "And I'm really concerned that it's going to have a lot of negative effect."

yes that is true they will go there in that case but it obviously is far from the case every surrounding city is very large and has NUMEROUS dispensaries everyone in garden grove just goes to the next city over so it doesn't make any difference to have it in GG or not

GG sucks anyway. Even if they did manage to open a clinic there, I'm sure prices would be $80/ eighths

while were at it lets ban all the CVS's and walgreens, to cut down on the perscription painkiller abuse. yeah thatll work. morons.

I wonder what people in California did before there were dispensaries when they wanted to buy some weed. They act like there's no other way to still get weed in that area without their being a dispernsery right there...
I'm from Boston and we aren't even a medical state, so we have 0 dispensaries, and there's weed everywhere.
