I don't think this is true.  While true, I believe, under federal law, no state has such a provision and thus it is illegal under both state and federal law, as it is a violation of federal law to unlawfully sell drugs, even if it is only violating a state law.

Kinda like how the feds can prosecute you for owning a firearm only illegal under state law, but not under the federal law.  The feds have catch all laws in many areas that prohibit violations of state laws.

They like to be able to get you for anything they want.  But don't worry, they have this great power cuz they are competent to make great decisions.

The reason I believe C-V mixtures are allowed under Federal law is the control measures for each schedule:

Schedule II: Prescription only, oral Rx is allowed for 30 days worth of medication, no refills.

Schedule III: Prescription only, may be refilled 5 times within 6 months.

Schedule IV: Prescription only, may be refilled 5 times within 6 months.

Schedule V: Dispensed only for medical purpose.

No mention of prescription in the federal control of scheduled substances schedule V
