Lawyer wants troopers to prove pot-sniffing July 9, 2008 - macon.com
The lawyer for a man accused of having 10 pounds of marijuana says something about the arrest smells. He wants two Georgia State Patrol troopers to prove they can sniff out pot tied up in a trash bag inside a car trunk.
If troopers Jeff Adamson and Kevin Turner are unable to repeat the feat with a random car in the Gordon County courthouse parking lot, attorney David West says the evidence against Jarmane Vernon Knox should be suppressed for lack of probable cause for a search.
West says: "If these officers really think they are human drug dogs, let's put them to the test."
Knox and passenger Derrick Mikes were stopped on Interstate 75, initially because the license plate tag light was out.

yeah, 10 pounds would be EASY. The stuff my buddy growing stanks like you wouldn't believe... he came by my house just 3 days ago... He tells me to smell his car... I do, and it REAKS! then he takes me to his trunk and takes a rolled-up sock out of his spare-tire... Inside the sock is a dime-bag with a nug in it. If he had 10 pounds of this stuff in the trunk with a garbage bag, the whole block would smell.... I do know what this lawyer is getting at though... I got pulled over 4 months back for an out-of-date sticker. The cops started grilling me about drugs(I only went out for a coffee) I naturally denied everything, especially considering i didn't even have anything with me(rare). Well I'll be damned if these guys didn't say: "Well we smell marijuana, that gives us the right to search your vehicle without your permission" They promptly hauled me out, cuffed me, and put me in the back of a cruiser for an hour while they tore-apart my car... No weed sry. but here's an $85 ticket for your missing sticker... See they used to do this with the smell of alcohol, until people got wise and demanded breathalyser tests. Now they use weed as the excuse since there aren't any tests....

So if I take ten cars, put 10-lbs of cannabis in one of them and ten-lbs of various forms of grass, cleome, and legal hemp cuttings in the other 9, you are claiming that the one that contains cannabis can be identified by the human nose? That cop must have one hell of an impressive sense of smell.

Once you know what smell to sniff for, it shouldn't be that hard. Let's get real people. Sure we would like to think that COPS are such newbs they can't determine the difference between the smell of POT, and something else. Fact is, COPS pride themselves on their ability to smell "Grass". Ever been to a concert and seen COPS scoping the crowd cause they caught a whiff of something? COPS may be assholes sometimes and even unfair, but they aren't all idiots.
However, kudos to the lawyer that came up with this defense. It's worth a shot. Good luck.

Hey this is my home town. I've been waiting for the day I'd finally see something on the shroomery news from around here and here we go. I can't believe they got him on I-75 though and for a defective tag-light? I go 10-15mph over the limit on that road all the time riding dirty or clean and I've never been pulled over. 10 pounds though.. that sucks. Prices might go up.. I might have to actually pay $30 for a quarter hahaha.

Just imagine it was yourself, would you just heave 10 lbs in the trunk and shut it?
You package it all in a compressed wrapper per pound, then put those inside like 3 or 4 trashbags (at least), and then impulse seal it shut lol
potheads are noidy, don't underestimate their craftiness. I bet they minimized that smell to almost nil.

The challenge is based on re-creating the same elements of the original situation. If his light was out, thats a legal reason to be pulled over, not searched. So, most likely it was the two cops and the one car. Providing 9 other cars is to blind the study. Filling them with hemp and other materials that smell tilts the tables to the alleged offender quite unfairly (based on law, not my biases). GL to him and his lawyer. I love when people challenge cops legally.

I gave up on the police being able to help me a long time ago. Now i know that they're just here to make the country money by writing tickets and incarcerating nonviolent offenders. My little sister was raped by one of my best friends that had known her since she was 6. The police told us to get a "rape kit" done immediately because the evidence inside her body was time sensitive. We sped our way to downtown St. Louis because we live about an hour outside of town and were pulled over on our way. When we told the police officer why we were speeding, he got cocky as fuck as told us we didn't need to be driving that fast. He wrote me a ticket and didn't even give me an escort. My sister who was raped cried the whole time in the back seat while the cop harassed me and told me if he caught me speeding on my way to the hospital again that he was going to take me to jail. My sister's rapist never got charged either because cops don't know how to do their jobs, they just know how to send fresh meat into the drug court machine.
I will never call the police for help.
