civil suit after being stabbed?
    #8609027 - 07/08/08 05:01 PM (1 month, 28 days ago)

i was almost killed saturday night, the story is all here: i got stabbed

the guy who stabbed me is apparently broke, but i'm wondering if its a good idea to file a civil suit against him. the suit would be mostly for medical bills, but since i havent recieved the final bill yet, i dont know how much i would sue him for. anybody have any legal advice on how much it would cost to file suit, how long it might take, if it would be worth it?

thanks

I read your post in the P&MWB forum, get well soon.

The state attorney should contact you soon to ask you how you want the case handled, if you choose probation/community control/house arrest the offender will have to pay restitution which will include medical bills, if your state has a victims resource fund the state attorney can write you a check for testifying at trial should he choose to go that route.

If you're in Florida the check can be up to $21,000 depending on the charge. Usually only women get that money though, very rare for a man to get any victims resource money, even with severe injury and attempted murder charges against the defendant.

I'm not sure about the civil suit route, especially since the guys broke, are you sure he has no assets that you can file an injunction and then sue??

The thesis that I want to advance today is that the drug war and the laws that prohibit the private consumption of certain drugs are unconstitutional. Prohibition laws, themselves, violate every tenet of limited government that is embodied in our Constitution.

im not 100% positive, i've been at the trailer he grew up in. his parents have no money, and from the times i met him, i highly doubt he does either.

the DA is supposed to call me in the next month, but i won't be for anything but prison.

You never know when somebody is going to get lucky and win the lottery, etc.  If you have won a civil suit in the past, then you have recourse to claim his windfall to pay for the medical bills he created.  If nothing else, at least take him to small claims where you represent yourself and lawyers are not allowed.  However, the maximum you can sue for in small claims is... small.
