Well MYC itself is not illegal in some states like in Florida for example. Fresh shrooms apparently are not either, only dry psilocybe.
But im sure if they catch someone growing it the laws will bend. I think these laws are made more for people who might accidently pick one of the many wild ones that grow in that state..

go out into a feild and pick as many fresh shrooms you want (in florida) and then go up to a cop and say look what I just picked
youll be fucked
that shit is a myth all it is for is for people (like you said) that are actually picking edible mushrooms and one active accidental slips in and even then they can be charged. Its not "fresh mushrooms are legal"

uhhhhh.....not exactly. If certain circumstances are met such as , proving you had no prior knowledge of them being a "vessel" for an illegal substance.
Also I knew a guy(in prison now) that got popped because of another warrant and all he had was partially colinized. This was in Ft.Walton beach , FL. in '06.

Thats what i was refering to, the accidental theory. Also I have a friend who lives in florida and was stopped by cops. After getting searched cop found bag of shrooms, looked at them like they were a petty offense, threw it back in the car and asked my friend where the "REAL" drugs were.
