IC student found with mushrooms gets discharge

ITHACA — An Ithaca College student convicted of possessing hallucinogenic mushrooms was given a three-year conditional discharge and sentenced to 100 hours of community service in Tompkins County Court Friday.
Benjamin R. Miller, 20, of New Hampshire, pleaded guilty to attempted fourth-degree criminal possession of a controlled substance, a D felony, in connection with an incident at his dorm room on Jan. 22, 2007.
Ithaca College Public Safety officers responded to a report of a suspicious odor coming from Miller's dorm room that day, according to court records. Miller answered the door, admitted to smoking marijuana and allowed officers to search his room.
Officers found the mushrooms, about 3.3 grams of marijuana, a pipe with marijuana residue and an electronic scale with a small amount of marijuana, according to court documents. The mushrooms weighed about 100 milligrams and contained the hallucinogen psilocybin. He was charged with fourth-degree criminal possession of a controlled substance, a C felony.
Miller was released to the supervision of probation after his arrest and completed drug counseling, according to court records and courtroom testimony Friday. Citing a favorable probation report, Judge John Rowley ordered Miller to complete another substance-abuse program but allowed him to keep his driver's license.

Sounds like he hid/threw away most of his shroom stash but forgot a piece, which was left in the open. I see no reason to own 0.1g of a cubensis cap/stem unless you're looking at it under a microscope, which he probably wasn't.

Seriously. You can't even feel bad for the kid, it was all his own fault. He was smoking in his dorm and got the cops or safety officers or whatever called then lets them search and find some shrooms so they could charge him with that too.
He's lucky though, he got off incredibly easy. They even let him keep his license for felony drug possession. In our state, even for simple cannabis possession (which isn't even really considered that much of a crime here, just a fine) there is still a 6 month mandatory license suspension. Plus a scale with drugs equals intent to distribute is some areas.

Oh man don't get me started, the law is totally unethical. I was just stating that they are doing their job, whether right or wrong, and there isn't much of a way to change that unless you change the laws. I don't get mad at the police. Its the government who made these outrageous laws, and then pay police officers to enforce them.
Generally police officers are people who need a job badly(no school etc.) to support a family. They get sucked in, and so you can't really blame them. I in no way support what the police do, but at the same time they aren't(completely) the ones to blame. I guess we just have to continue our work on the government to revisit these wonderful laws we have. I love that they can tell me what, and what I can't put into my body. Fucking BS.
