WENATCHEE — Three suspects in an April 25 home invasion robbery on the outskirts of Wenatchee — one of whom is charged with rape — appeared for their arraignments Monday in Chelan County Superior Court.
The accused rapist, 16-year-old Thomas T. Aranda of Wenatchee, who is being charged as an adult, was not allowed to enter a plea in court because his public defender, Jeremy Ford, told Judge Lesley Allan that he had previously represented a witness in the case on a drug charge.
Allan ordered another lawyer be appointed to represent Aranda and postponed his arraignment until Wednesday. Before learning of the possible conflict shortly before the arraignment, Ford had entered a not guilty plea on Aranda's behalf through papers filed with the court. Aranda is charged with first-degree rape, first-degree robbery, first-degree burglary and second-degree unlawful possession of a firearm. He faces a maximum penalty of life in prison, as do four others alleged to have participated in the break-in at a home in the 2500 block of No. 2 Canyon Road.
Tyler D. Bymaster, 23, of East Wenatchee, and Tanner J. Helvey, 17, of East Wenatchee, both pleaded not guilty to charges of first-degree robbery and first-degree burglary during their brief appearances Monday. Helvey also pleaded not guilty to a charge of second-degree unlawful possession of a firearm. Allan set a July 8 trial date for both.
Jason T. Hernandez, 25, of East Wenatchee, and Braden J. Crocker, 19, of East Wenatchee, also are charged with first-degree robbery and first-degree burglary. Hernandez is scheduled for arraignment Wednesday, and Crocker on May 21.
In affidavits filed April 30 and May 2 in court, the Chelan County Sheriff's Office reported the two suspects who offered statements after being arrested indicated they meant to "rip off" a man who lived at the house because another suspect, who refused to give a statement, had said the man "shorted" him on a purchase of hallucinogenic mushrooms two weeks earlier. Deputies wrote in the affidavits that people in the house said two intruders had rifle-type guns and another had a pistol. Witnesses said the assailants, who covered their faces with bandanas, kicked open the front door, hit one man in the face three times with the butt of a gun and held them at gunpoint demanding to know which room belonged to the man involved in the mushroom deal, according to deputies. The 21-year-old man in the room said he locked his door, grabbed a shotgun, jumped out a window and called 911 once outside. Sheriff's office deputies arrested the man April 30 on a charge of possessing marijuana with intent to deliver. He has not been charged.
Witnesses said a 20-year-old woman and her boyfriend were ordered out of another room at gunpoint, according to sheriff's office reports. The two were forced to lie face-down in the living room. The woman, who was naked and had wrapped herself in a blanket before leaving the bedroom, was ordered to return to it by a male wielding a pistol, witnesses told deputies. Deputies said the woman told them the male raped her. The male held the pistol to her head each time she refused to perform a sexual act, deputies said the woman told them. The victim identified the dark-colored hooded sweatshirt worn by her attacker, leading detectives to question Aranda, who was wearing a dark-blue hooded sweatshirt.
Deputies and police pulled over a Ford Explorer that the five suspects were allegedly in a few minutes after receiving the 911 call. The lead deputy responding to the house reported that he passed the truck heading in the opposite direction and saw items being thrown from the windows. He asked trailing police and deputies to stop the truck. Inside the truck, deputies reported finding a shotgun, rifle and a pistol, as well as marijuana, mushrooms, open alcohol containers and a "wad" of cash. The amount was not specified. A deputy found several latex gloves in the area that he believed were among the items he saw being tossed from the truck window.
