I wouldn't have said yes to a search.
If you KNOW there's nothing in the car and there IS something in your pocket, the best thing you can do is let them search.
If chubbycharley had refused the search, it would have made the cops suspicious, especially given his confession of a prior drug offense. They would have detained him until they could bring out a drug dog.
The dog would have indicated on the car door handle. Sure, there was nothing in the car, but since chubbycharley had been smoking, his hands had traces of weed on them and that smell would have ended up on the car door handle. A dog can easily smell that.
Once the dog indicates on the door handle, you can be pretty sure that they'll follow up chubbycharley's physical patdown with the dog, and the dog would not miss what was in his pocket.
Be smart. Contrary to the popular opinion, it's not always in your best interest to refuse a search. If a dog will fuck things up for you and there's nothing in the car for the police to find, the best thing to do is to just let them search. When they find nothing, they'll relax and your chances improve.
Every situation is different. Always consider all the possibilities carefully before you make the mistake of refusing a search.

One time when I was a stupid little freshman stoner, I had just bought my first pipe and was preparing to smuggle it back up to school. I decided to keep the thing in the front pouch of a hoodie on a plane the whole way there (I know, stupid thing to do, but I was reaaalllly new to drugs and nobody had been around to smack me yet). I kind of noticed it was a little smelly in my mom's car, so I stuck a hand in there to check out the bowl, and there was a still loaded, half smoked bowl my friend had stuck in there and not finished. So I get to the airport and decide to dump it out in the bathroom. As soon as I enter every fucking female security cop in the airport decides to piss at the same time, so they were treated to the sounds of me scraping out a bowl in the stall next to them. It was skunky.
After that, whenever travelling in an airport I've always stuck weed/ paraphernalia in a soft, protective airtight casing and smuggled it in a place that doesn't mind accepting the presence of hefty objects. You'd be SURPRISED what you can fit up there. I've heard stories about super compressed QPs making it through airports. So for people on the road: try to have at least one vagina in the car at all times. Its the safest place to hide your shit, and it doesn't involve any shit.

yeah, you got walked all over, catch 22. I would have respectfully denied both the search of my body and car if all I had were expired plates. Fuck the useless poe, because they are persecuting, not protecting, and right now someone is being raped or stabbed.

Whenever you have a prior drug offense it's usually a little different when you say no to a search, as apposed to if you had no prior offense. They will usually call the drug dog if you say no with a prior.
