It still would have to be passed by Congress.
And it will be, just like how the Patriot Act (unconstitutional) was. It will pass at 4am, under a bomb threat or some other "terrorist" threat. Have we already forgotten how bush and crew choose to play their side of the game?
I thought the Democrats were going to change all that? Nothing has changed.
Constitional or not, not one congressman read the actual Patriot Act bill before voting on it. Kind of scary. I like some of the comments that Ron Paul has made about it. Like how just the name of it, The Patriot Act, if you voted against it the implication is that you are somehow Un-Patriotic and not a Patriot.

They still cant pass any bills or get rid of any previous bullshit because of Bush's veto. At least they wont feed Bush any more new bullshit to sign.

Where did you get your farcical understanding of the law?
Sarcasm and condescension do not befit you.
I believe the words in the actual Constitution would affect the Constitutionality of an act of congress until the time may come when a high court has to rule on the act.
And yet there are laws with much greater significance and precedence than the Constitution itself.
