Brunswick man had hallucinogenic mushrooms

A town of Brunswick man has been charged with felony drug possession after he was found to have three pounds of hallucinogenic mushrooms as he was about to board a train for Buffalo, Rensselaer County sheriff's deputies said today.
William J. Gallagher, 22, of Seneca Street was arrested Friday, deputies said. An investigation by the sheriff's office and county Drug Task Force was started and a search warrant was obtained for Gallagher's residence.
That night, as a result of the search warrant execution, officers said they discovered a marijuana-growing operation consisting of 116 marijuana plants. Also seized were two safes containing another pound of mushrooms along with marijuana, LSD, ketamine, hashish and 346 ephedrine tablets, deputies said. Marijuana-growing equipment, scales and other assorted drug paraphernalia was also seized, deputies said. Gallagher was arraigned in Rensselaer City Court on a charge of second-degree criminal possession of a controlled substance, a felony, and sent to the county jail without bail.

Wow the details in the article are overwelming.
My question, why no bail? You can kill someone around here and have atleast the potential to make bail. This guy doesnt have a chance. Although I believe bail is wrong, as is holding anyone in jail before a full trial. Bail is just a ransom for your freedom without due process.
Id like to know how he got caught on the train, but then again, 3 lbs of mushrooms isnt something easy to just hide. Damn...just wish there was more info on this one.

What better way to get a warrant? He was found with illegal substances...there is nothing wrong with them searching his home after finding that. Its not like he had an ounce on him...he had a large amount. Althoug I disagree with the drug laws, under our current system that warrant was very fairly obtained.
How else should they get warrants? Would you rather they just go by tips? This guy had possession, they had every reason to suspect a larger operation. Unless you think that warrants in general are bogus and the government has no right entering your property under any circumstances...and that is debateable and id love to have that debate...but its not really in the context of this article. (btw, im not sure what my opinions on warrants to search houses are...its not something I have taken the time to consider, and there is alot to take into consideration when forming an opinion on something such as that...which is why id love the debate because it would inspire thought  )

hence have a under cover watch his every move, monitor his phone calls, high electric bills, etc...

Nah, you get caught with that much on you and a warrant is justified. However, the scope of the warrant could be debateable too. He was found with mushrooms, that doesnt mean they can tear his place up looking for anything else to incriminate him.

Brunswick man gets prison on drug charge
TROY - A Brunswick man will spend three years in prison after pleading guilty this morning to being caught last month with three pounds of hallucinogenic mushrooms in his bags as he was about to board a train for Buffalo.
It was not the mushrooms though that initially got William J. Gallagher, 22, the attention of the deputies of the Rensselaer County Sheriff Department who patrol the Rensselaer train station.
"I was traveling and an officer said I had a smell of marijuana," Gallagher told Judge Patrick McGrath during his plea. "They then found the mushrooms in my bag."
Police got an even bigger surprise when they obtained a search warrant for Gallagher's Seneca Street home.
Officers said they discovered a marijuana-growing operation consisting of 116 marijuana plants in various growth stages. They also seized two safes containing another pound of mushrooms along with bagged marijuana, LSD, ketamine, hashish and 346 ephedrine tablets.
Gallagher was originally charged with two counts of second-degree criminal possession but pleaded guilty to a count of third-degree possession this morning, a felony.
He will also have to serve two years' post release supervision and will be sentenced April 16.

He's going to serve 3 years, and 2 years supervised release, but he's going to be sentenced on April 16th? What?
Or are the 3 years for carrying the mushrooms and he's due to be sentenced for what was found at his home on the 16th?

The reason why drugs sell for so much money is because of the penalties, if they didn't give out jail time for making drugs they would be a lot cheaper.

Anyone here will agree that this kind of time for a non violent crime is absurd. However, if 3 years is the complete sentance, it's much lighter than I was expecting. As others have said, I thought perhaps he'd not see the light of day in at least a very very long time. 1.5 years of actual time for a stupid mistake like that isn't justice, but it could have been much worse.

He got the three years via a plea deal. So despite the fact that he hasn't been sentenced yet he already knows what his sentence will be because of the plea deal.
