Adam Burch Act Introduced to Punish Drug Dealers in Oregon February 3, 2007 - salem-news.com
House Bill 2610 holds dealers criminally liable creating new Class A felonies.
Beth Jackson of Keizer wants Oregon to take a page out of the federal drug laws handbook and her state legislator is ready to help her.
At Jackson’s request, Representative Kim Thatcher (R-Keizer) introduced House Bill 2610, the “Adam Burch Act”, to allow prosecutors to go after drug dealers who cause the death or serious injury of another person.
“The amount of grieving can’t be measured because there are no words to describe the loss we have suffered,” said Jackson.
She had a brother-in-law die from a heroin overdose in 2003.
A year later, she lost another one to heroin.
He was 19-year old Adam Burch of Salem.
In that case, the U.S. Attorney’s Office was able to convict the three people who supplied drugs to Burch.
They’re now serving 10 years in federal prison.
“We need a law in Oregon similar to the one the feds use,” said Thatcher referring to the Len Bias Act adopted by Congress 20 years ago in honor of the Boston Celtics basketball star who died from a cocaine overdose in 1986.
Under that statute, drug dealers are held responsible for causing death or serious injury and face 20-years minimum behind bars.
Thatcher was on the House Judiciary Committee in 2005.
House Bill 2610 is similar in that it holds dealers criminally liable creating new Class A felonies.
“Drug Induced Homicide” carries a 20 year mandatory minimum sentence if someone manufactures or distributes controlled substances to a person who dies as a result.
“Drug Induced Assault” carries a mandatory minimum of 12 years.
Early release is not allowed in either crime.
Jackson has worked with Katie Suver a Marion County Assistant District Attorney and member of the legislative committee for the Oregon District Attorney’s Association.
Suver noted the ODAA, “would support a law to criminalize conduct that results in death, specifically related to drugs. We believe it would have a deterrent effect on individuals who traffic in controlled substances.”
“We want to send a message to those who deal drugs, that this kind of conduct will not be tolerated. This message has to be very clear. If you distribute drugs in our community, you will suffer significant consequences,” explained Jackson. “This is sound public policy that is not being created to strike at heroin addicts, but at the dealers who distribute this poison.”
The federal sanctions have only been applied in two cases in Oregon.
Several other states have adopted their own Len Bias laws. Officials estimate there are nearly 200 drug related deaths in Oregon every year.
House Bill 2610 will get a first reading in the House of Representatives next week.

Dang I know what their saying but..... It's the abusers responsibility to know his/her limits. And I'm not sayin drug dealing is good in the first place. It's like arresting a liquor store owner sayin that one of their customers died of alcohol poisoning and it's time to go to jail. America's a crazy place to be in....

Here we go again. Let's further separate Americans from personal responsibility.
pane_freake makes a great point. Yeah to make it fair lets arrest liquer store owners, tobacco industry workers, winery owners, etc.
When are they going to realize that there is no amount of people you can lock up to save one man from himself.

I don't think this law goes far enough.
It needs to extend to the car companies as well..
How can i be responsible for my own safety if a company like Honda is going to produce a car that has the potential to kill me?

Actually there is little to be said fireworks_god this is alread Federal Law - the Len Bias law it a common name for it after the Boston Celtic BBall player who overdose in the 80s. It was one of the worst drug laws on the books with a mandatory min. of 20 years - if you have a one drug conviction already you can get life.
Must hard drug dealers on the street level are addicts themselves and invovled in selling probably mainly because of their addiction if they should be helped not imprisoned each case needs to be looked at.
This law while on the books is not very often prosecuted.

Yeah, shit just keeps getting worse and worse.....
People need to wake up the fuck up, and we need to take our freedom back.
I've lost friends to ODs, and therefore know this pain all to well. However, it was their lives, their bodies, THEIR CHOICE. They knew the risks, we all do. This law is fucking retarded, and wrong on so many levels and I fervently hope it gets shot down. Sadly though, in this day of sheep I'm afraid that won't happen.
Fucking lame, this is the dark ages folks.

I made a comment similar to yours at least a year ago, and someone replied that they were in fact starting to jail bartenders who let people out of their bars while obviously too drunk. I'm too lazy / tripping to look it up right now but maybe later I'll try to find that post.

I'm not entirely sure how I feel about that.
Anyone who watches a stumbling-ass drunk person climb behind the wheel and does nothing is a shame to society. But is punishment the solution? Is it not ridiculous that such a small sliver of concern for one's fellow humans can't be developed without threatening to take away personal freedoms?

I worded my earlier post wrong. I meant I asked a question similar to yours about a year ago. Anyhow I agree completely. It should be possible to rectify a situation without it always resulting in jail / prison / court dates / the justice system in general.

Actually... This is already the case. You can be prosecuted, as a bartender, if you serve someone excessive alcohol and they receive are involved in an accident after the fact. It's just hard to prove. (I.e. the cops call and say such and such got in an accident... who served him? Assuming there's more than one bartender, everyone says it was Mr. Nobody.)
If you're a server/bartender and done the ABC liquor class you'll know what I'm talking about.

Uhh... Do you GO to bars much, or know anyone that does? I never realized how rampant drunk driving is until I started going to clubs more often. It seems like *everyone* drives drunk.

Sure. A friday night in a college town can be absolutely absurd. I just meant to emphasize the point that forcing punishment can only get you so far, and that a real sense of social responsibility is what needs to be developed. My point is that we're all a "shame" in that way. Nearly everyone does drive drunk at some point. Then there are those who drive absolutely plastered... the point where you'd be unable to flush a toilet, let alone drive.

Given how low the ACTUAL limits are it's hard not to drive intoxicated, I used to goto happy hour a few times a week to meet with friends and socialize on the way home from work my one friend picked up a DWAI after 2 dark beers (pints).
